HomeMy WebLinkAbout66-72 - Vacation - Northerly 30' Gisler Avenue for 1730 FeetRESOLUTION N0. 66-72 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE VACATION OF THE NORTHERLY 30 FEED OF GISLER AVENUE FOR A DISTANCE OF 1730 FEET WESTERLY FROM FAIRVIEW ROAD IN THE CITY OF COSTA MESA. The City Council of the City of Costa Mesa does hereby resolve as follows : SECTION 1. The City Council of the City of Costa Mesa does hereby declare its intention to vacate that certain right of way described as follows: PARCEL A. A parcel of land lying within Section 34, Township 5 South, Range 10 West, S.B.M., more particularly described as follows: Beginning at a point in the center line of Gisler Avenue, 60 feet in width, as shown on a map of Tract No. 4356, recorded in book 168, pages 34 through 36 of Miscellaneous Maps, records of Orange County, California, said point being the intersection of said center line with the Westerly line of that parcel of land deeded to the State of Cal- ifornia for freeway purposes and recorded June 2, 1965 in book 7540, pages 953 through 955 of Official Records, said point being South 890 28' 35" West, 102.70 feet, measured along the center line of Gisler Avenue, from the center line of Fairview Road, as said center line is shown on said map of Tract No. 4356; thence South 890 28' 35" West, along said center line of Gisler Avenue, 464.39 feet, to the Southerly prolongation of the Easterly line of an easement described as Parcel No. 5 in a deed to the City of Costa Mesa, recorded in book 7588, page 282 of Official Records; thence North 00 36' 03" West, along said Southerly prolongation, 30.00 feet to the Northerly line of Gisler Avenue; thence North 890 28' 35" East, along said Northerly line of Gisler Avenue, 462.28 feet to the previously mentioned Westerly line of that parcel of land dedicated to the State of California for free- way purposes; thence South 40 37' 07" East along said Westerly line, 30.08 feet to the point of beginning. PARCEL B. A parcel of land lying within Section 34, Township 5 South, Range 10 West, S.B.M., more particularly described as follows: Beginning at a point in the center line of Gisler Avenue, 60 feet in width, as shown on a map of Tract No. 4356, recorded in book 168, pages 34 through 36 of Miscellaneous Maps, records of Orange County, California, said point being South 890 28' 35" West, 474.39 feet, measured along the center line of Gisler Avenue, from the center line of Fairview Road, as said center line is shown on said map of Tract No. 4356, said point also being in the Southerly prolongation of the Westerly line of an easement described as Parcel No. 5 in a deed to the City of Costa Mesa, recorded in book 7588, page 282 of Official Records; thence South 890 28' 35" West, along said center line of Gisler Avenue, 417.00 feet to the South- erly prolongation of the Easterly line of an easement described as Parcel No. 6 in a deed to the City of Costa Mesa, recorded in book 7588, page 282 of Official Records; thence North 00 36' 03" West, along said Southerly prolongation, 30.00 feet to the Northerly line of Gisler Avenue; thence North 890 28' 35" East, along said Northerly line of Gisler Avenue, 417.00 feet to said Southerly prolongation of the Westerly line of an easement described as Parcel No. 5; thence South 00 36' 03" East, along said Southerly prolongation 30.00 feet to the point of beginning. PARCEL C. A parcel of land lying within Section 34, Township 5 South, Range 10 West, S.B.M., more particularly described as follows: Beginning at a point in the center line of Gisler Avenue, 60 feet in width, as shown on a map of Tract No. 4356, recorded in book 168, pages 34 through 36 of Miscellaneous Maps, records of Orange County, California, said point being South 890 28' 35" West, 901.39 feet, measured along the center line of Gisler Avenue, from the center line of Fairview Road, as said center line is shown on said map of Tract No. 4356, said point also being in the Southerly prolongation of the Westerly line of an easement described as Parcel No. 6 in a deed to the City of Costa Mesa, recorded in book 7588, page 282 of Official Records; thence South 890 28' 35" West, along said center line of Gisler Avenue, 417.00 feet to the Southerly prolongation of the Easterly line of an easement described as Parcel No. 7 in a deed to the City of Costa Mesa, recorded in book 7588, page 282 of Official Records; thence North 00 36' 03" West, along said Southerly prolongation, 30.00 feet to the Northerly line of Gisler Avenue; thence North 890 28' 35" East along said Northerly line of Gisler Avenue, 417.00 feet to said Southerly prolongation of the Westerly line of an easement described as Parcel No. 6; thence South 00 36' 03" East, along said Southerly prolongation, 30.00 feet to the point of beginning. PARCEL D. A parcel of land lying within Section 34, Township 5 South, Range 10 West, S.B.M., more particularly described as follows: Beginning at a point in the center line of Gisler Avenue, 60 feet in width, as shown on a map of Tract No. 4356, recorded in book 168, pages 34 through 36 of Miscellaneous Maps, records of Orange County, California, said point being South 890 28' 35" West, 1328.39 feet, measured along the center line of Gisler Avenue, from the center line of Fairview Road, as said center line is shown on said map of Tract No. 4356, said point also being in the Southerly prolongation of the Westerly line of an easement described as Parcel No. 7 in a deed to the City of Costa Mesa, recorded in book 7588, page 282 of Official Records; thence South 890 28' 35" West, along said center line of Gisler Avenue, 379.96 feet; thence North 00 31' 25" West, 30.00 feet to the Northerly line of Gisler Avenue; thence North 890 28' 35" East along said Northerly line of Gisler Avenue, 379.92 feet to said Southerly prolongation of the Westerly line of an easement described as Parcel No. 7; thence South 00 36' 03" East, along said Southerly prolongation 30.00 feet to the point of beginning. SECTION 2. Tuesday, the bth day of September, 1966, at the hour of 7:30 o'clock p.m., in the Council Chamber at the Costa Mesa City Hall, 695 West 19th Street, Costa Mesa, California, is hereby fixed as the time and place for hearing all persons interested in or objecting to the proposed vacation. SECTION 3. These proceedings shall be conducted pursuant to the provisions of Chapter II, Part 3, Division 9 of the Streets and Highways Code of the State of California. SECTION 4. The City Manager of the City of Costa Mesa is hereby directed to cause notices of the said proposed vacation to be conspicu- ously posted along said strip of land for at least ten (10) days before the date of said hearing. Said notices shall be posted not more than three hundred (300) feet apart, but in no event shall less than three (3) notices be posted. SECTION 5. This Resolution shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation printed in the City of Costa Mesa, County of Orange, State of California.
