HomeMy WebLinkAbout67-14 - Palace Avenue Improvement District - Appointing Engineer, Attorney317 RESOLUTION N0. 67-14 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPOINTING ENGINEER AND ATTORNEY IN CONNECTION WITH PALACE AVENUE IMPROVEMENT DISTRICT (ASSESSMENT DISTRICT N0. 16): ESTABLISHING THE COMPENSATION EOR SAID ENGINEER AND ATTORNEY AND DIRECTING THE PREPARATION OF PLANS AND SPECIFI- CATIONS EOR SAID IMPROVEMENT DISTRICT. EThe City Council of the City of Costa Mesa does hereby resolve and determine as follows: SECTION 1. D. Southworth be, and he is hereby appointed to act as Superintendent of Streets and/or Engineer of Work for the proposed improvement of Palace Avenue Improvement District in the City of Costa Mesa, to be had and taken under the provisions of the "Improvement Act of 1911," being Division 7 of the Streets and Highways Code of the State of California; and that the said D. Southworth is hereby authorized and directed to perform all duties imposed upon the Superintendent of Streets by Division 7, and all of the provisions of Division 7 applicable to the Superintendent of Streets shall apply to said person so appointed. SECTION 2. The compensation to be paid said Engineer is as follows: A. For construction plans, specifications and cost estimate, assessment diagram - six ((p) percent of the cost of construction. B. For construction inspection and supervision, construction staking and final cost preparation - four (4p) of the cost of construction. C. For preparation of assessment, preparation of bonds and bond registra- tion - three (3p) of the cost of construction. SECTION 3• Roy E. June, City Attorney of the City of Costa Mesa, is hereby appointed as the attorney for Palace Avenue Improvement District, Assessment District No. 16, to conduct all the legal proceedings and prepare all the necessary legal documents in connection with said .Palace Avenue Improvement District, Assessment District No. 16. SECTION 4. The compensation to be paid said attorney for his service is as follows: A. For preparing petitions, resolutions, resolution of intention, notices, hearings and all other documents and legal work in connection with said Assess- ment District - three (3p) of the cost of construction, and the acquisition of right of way. SECTION 5• D. Southworth is hereby directed to prepare plans and speci- fications for the grading, paving, construction of curbs and gutters, cross gutters, sewer main and appurtenances, sewer manholes, water main and appurten- ances, house connection sewers, water service house connections, traffic control signals, street lights, fire hydrants, removal of obstructions and appurtenant work in connection therewith, in Palace Avenue, said plan to be known and desig- nated as Plan No. 15• PASSED AND ADOPTED this 6th day of February, 1967.
