HomeMy WebLinkAbout67-50 - Maselli (Topless Dancers) Case - Findings AdoptedRESOLUTION N0. 67-50 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING AND ADOPTING FINDINGS FROM PUBLIC HEARINGS CONDUCTED MARCH 20, 1967, INVOLVING APPLICANT HARRY MASELLI. THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: THAT WHEREAS, a hearing was conducted on March 20, 1967, concerning applicant HARRY MASELLI for topless dancers, and; WHEREAS, pursuant to an order of the court dated April 7, 1967, the City Council was ordered to make findings. NOW, THEREFORE, the following finds are declared, found and adopted by the City Council of the City of Costa Mesa: After having considered the application of HARRY MASELLI for seven (7) entertainers, being a live band and dancers and after conducting a public hearing at which Mr. Maselli and his attorney, Berrien E. Moore, were present, and after hearing the testimony of members of the general public, the City Chief of Police, the City Fire Chief, the Orange County Health Department Representative, the City Director of Planning, and after examining a petition containing 1531 signatures in opposition to any application for topless type entertainment, and after affording the attorney for the applicant unlimited opportunity to cross examine all witnesses and upon the cross examination conducted by Council for applicant and after individual council member inquiries of all witnesses and members of the general public speaking for and against the application and basing their decision further in part upon their own knowledge of the applicant's proposed type of entertainment and taking into account the fact that applicant presented no evidence in support of his application; the Council makes the following findings: 1. That the applicant has demonstrated that he is unfit to be trusted with priviledges granted by a permit. 2. That the type of entertainment proposed by the applicant does not comport with the peace, health, safety, convenience, good morals and general welfare of the public.
