HomeMy WebLinkAbout67-59 - River No. 5 Annexation - Intent to AnnexRESOLUTION N0. 67-59 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA OF INTENTION TO ANNEX TO SAID CITY A CERTAIN UNINHABITED AREA DESIGNATED AS "RIVER NO. 5 ANNEXATION" AND NOTICE OF THE PROPOSED ANNEXATION OF TERRITORY TO THE COSTA MESA RECREATION AND PARK DISTRICT OF ORANGE COUNTY AND THE COSTA MESA STREET LIGHTING DISTRICT. WHEREAS, there is situated outside of end contiguous to the City of Costa Mesa a certain uninhabited area as hereinafter more particularly described; and WHEREAS, it would be for the best interest of the City of Costa Mesa to annex the said hereinafter described area and the City Council does therefore initiate the annexation; and WHEREAS, the area referred to is also outside of and contiguous to the Costa Mesa Recreation and Park District, and the Costa Mesa Street Lighting District: and WHEREAS, the City Council of the City of Costa Mesa, as supervising authority of said Districts, finds and determines that said territory should be annexed to the existing Costa Mesa Recreation and Park District and the Costa Mesa Street Lighting District; and WHEREAS, the report of the Orange County Surveyor has been secured and reported upon by said Orange County Surveyor with respect to the definiteness and certainty of the proposed boundaries; and WHEREAS, said proposed annexation has been submitted to the Local Agency Formation Commission for review, and said Commission has found and determined its approval thereof; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Costa Mesa to annex to the City of Costa Mesa the said real property as hereinafter described, which said real property is at the present time uninhabited; and THEREFORE, BE IT RESOLVED FURTHER, by the City Council of the City of Costa Mesa as the supervising authority of the Costa Mesa Recreation and Park District and the Costa Mesa Street Lighting District, to annex to the existing Costa Mesa Recreation and Park District and the existing Costa Mesa Street Lighting District, the said real property as hereinafter described, which said real property is contiguous to the existing Costa Mesa Recreation and Park District and the Costa Mesa Street Lighting District. NOTICE IS HEREBY GIVEN that it is proposed by the City of Costa Mesa to annex to said City the herein described real property and to the Costa Mesa Recreation and Park District and the Costa Mesa Street Lighting District, which said real property will be known in these proceedings as the RIVER NO. 5 ANNEXATION to the City of Costa Mesa, the Costa Mesa Recreation and Park District, and the Costa Mesa Street Lighting District. The specific description of the boundaries of the territory proposed to be annexed to the City of Costa Mesa and the Costa Mesa Recreation and Park District and the Costa Mesa Street Lighting District is as follows: A parcel of land lying within a portion of Sections 28, 32 and 33, , Township 5 South, Range 10 West, and in a portion of Section 5, Township 6 South, Range 10 West in the County of Orange, State of California, more particularly described as follows: Beginning at an angle point in the existing boundary of the City of Costa Mesa as said boundary is described in the Talbert No. 1 Annexation 2'7 to said City, Ordinance No. 151, adopted January 7, 1957, said angle point being the intersection of the northerly line of Talbeit Avenue, 60 feet in width, as shown on a map of Tract No. 1083, recorded in Book 35, page 8 of Miscellaneous Maps, records of Orange County, California, with the northerly prolongation of the easterly line of the Santa Ana River, said easterly line being the easterly line of that 25 foot strip of land conveyed to the Orange County Flood Control District by deed, recorded August 21, 1948, in Book 1690, page 408 of Official Records; thence South 290 04' 00" West along said existing boundary, said northerly prolongation and said easterly line, 4701.84 feet to the beginning of a tangent curve, concave southeasterly, having a radius of 22,743.30 feet; thence southwesterly along said curve, through a central angle of 30 44' 37", an arc distance of 1486.01 feet to the southerly line of Gisler Avenue, as described in a deed to the County of Orange, recorded in Book 225, page 391 of Deeds, records of said Orange County, said southerly line being on the existing boundary as described in the Mesa Verde No. 1 Annexation to said City, Ordinance No. 227, adopted April 20, 1959; thence South 890 46' 55" East, along said southerly line and said existing boundary, 226.62 feet to a point on a non -tangent curve, concave southeasterly, having a radius of 22,538.30 feet, a radial line through said point bears North 640 25' 57" West, said curve also being the easterly line of the Greenville -Banning Channel as described in deeds to the Orange County Flood Control District, recorded in Book 4645, page 179 and Book 4367, page 346 of Official Records; thence southwesterly along said curve, said existing boundary and the existing boundary as described in the Adams No. 3 Annexation to said City, Ordinance No. 390, adopted September 18, 1961, through a central angle of 120 09' 03", an arc distance of 4779.74 feet to a tangent line; thence South 130 25' 00" West, along said tangent line and said existing boundary, 757.98 feet to a point on a line 50.00 feet northerly, measured at right angles, and parallel with the center line of Adams Avenue as described in a deed to the County of Orange, recorded December 4, 1908 in Book 160, page 180 of Deeds of said Orange County; thence South 890 29' 30" West along said parallel line and said existing boundary as described in Adams No. 4 Annexation to said City, Ordinance No. 62-7, adopted April 2, 1962, a distance of 236.96 feet to the easterly line of the Santa Ana River, 300 feet in width, as described in a deed to the Newbert Protection District, recorded June 22, 1911 in Book 197, Page 300 of Deeds, records of Orange County; thence departing from said existing boundary North 130 25' 00" East along said easterly line, 815.01 feet to a tangent curve, concave Southeasterly, having a radius of 22,768.30 feet; thence northeasterly along said curve through a central angle of 150 39' 00" an are distance of 6219.03 feet to a tangent line; thence North 290 04' 00" East, continuing along said easterly line, 4688.13 feet to the northerly line of said Talbert Avenue; thence South 890 40' 28" East along said northerly line, 28.53 feet to the point of beginning. FURTHER NOTICE IS HEREBY GIVEN that on the 3rd day of July, 1967, at the hour of 7:30 o'clock p.m., or as soon thereafter as it my be heard, in the Council Chamber at the City Hall, 77 Fair Drive, Costa Mesa, California, hearings will be held at which hearings the City Council shall hear and pass upon all written protests to the annexation to the City filed at any time before said hour set for said hearing,by any person owning real property within the territory so proposed to be annexed to said City and at any time before the said hour set for said hearing any owner of property within the territory proposed to be annexed may file a written protest against the annexation to said City. The protest shall set forth the name of the owner of the property affected and give a description of the property in general terms. NOTICE IS HEREBY FURTHER GIVEN that unless more than one (1) per cent of the total number of voters living within the territory proposed to be annexed to the Costa Mesa Recreation and Park District have, at or prior to said hearing, filed written objections to said annexation, the question of annexation shall M not be submitted to the voters at an election. At the time and place fixed for said hearing the City Council shall hear any person objecting to said annexation. The City Clerk of the City of Costa Mesa is hereby directed and authorized to cause a copy of this Resolution to be published twice in the ORANGE COAST DAILY PILOT, a newspaper of general circulation printed and published in the City of Costa Mesa, and twice in the NEWPORT HARBOR ENSIGN, a newspaper of general circulation printed and published in the County of Orange and outside of the City of Costa Mesa, said publications to be completed at least twenty (20) days prior to the date set for said hearing and constitute notice of said hearing.
