HomeMy WebLinkAbout68-12 - Application to the Local Agency Formation CommissionRESOLUTION N0. 68-12 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, MAKING APPLICATION TO THE LOCAL AGENCY FORMATION COMMISSION FOR ANNEXATION OF CERTAIN TERRITORY TO THE CITY OF COSTA MESA. THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: THAT WHEREAS, the City Council of the City of Costa Mesa desires to J initiate proceedings for the annexation of the hereinafter described territory to the City; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. This application is being made pursuant to the provisions of Division 2, Title 5 of the Government Code for the purpose of proposing the annexation of the hereinafter described territory to the City of Costa Mesa. 2. That the territory proposed to be annexed contains 28.4 acres and is contiguous to the City of Costa Mesa, said territory being specifically described in Exhibit "A" which is attached hereto and made a part hereof, con- sisting of four (4) type -written sheets of legal description. 3. That there is attached hereto marked Exhibit "B" and by this specific reference made a part hereof, a map of said territory proposed to be annexed. 4. That said map, together with a copy of the legal description heretofore described, has been filed with the Orange County Surveyor and with the Commis- sion, and that said Surveyor's office has indicated and represented to the Engineering Department of the City of Costa Mesa that its check of the boundaries should be completed by Friday, February 16, 1968. Said map is hereby referred to by reference and made a part hereof to the same force and effect as if set out herein or attached hereto. 5. That the territory proposed to be annexed is uninhabited. 6. That the reason for the proposed annexation is that the territory is ready for development and that City services are necessary for the protection of the health, safety, and welfare of the developers and that the City of Costa Mesa is the agency most feasible to provide said services to said area. 7. That there are no special terms or conditions to the proposed annexation. 8. That the agencies affected by said annexation to the best of applicant's knowledge are as follows: Orange County Sanitary District No. 7 Orange County Flood Control District Orange County Harbor District Mosquito Abatement District Orange County Library District Metropolitan Water District Santa Ana School District Orange County Road Commission Santa Ana Heights Water Company Irvine Water Company J Costa Mesa County Water District Orange Coast Junior College District Newport -Mesa Unified School District City of Santa Ana City of Newport Beach 9. That there is attached hereto requests from the following persons who own property within the territory to be annexed indicating their desire that said property be annexed to the City of Costa Mesa: Mr. James D. Ray Shell Oil Company (Stafac) Mr. Jack A. Thoner That attached hereto marked Exhibits "C," "D," and "E" are copies of the afore- said letters of request and consent. 10. That the City of Costa Mesa, through its agents, has personally con- tacted owners of property within the territory proposed to be annexed who have indicated that no opposition to said annexation will be made and that said owners of property are as follows: Irvine Ranch Company, President William R. Mason Union Oil Company Walter Schmid 11. That there has been compiled by authority of the City Council a questionnaire in the form provided for by the Commission pursuant to Section 54796 of the Government Code and that the same is submitted to the Commission concurrently with this Resolution. 12. That all notices with respect to hearing should be mailed to the following persons: Mr. A. R. McKenzie, City Manager, City Hall, 77 Fair Drive, Costa Mesa, California Mr. R. E. June, City Attorney, 1500 Adams, Suite 206, Costa Mesa, California Mr. George Madsen, City Engineer, City Hall, 77 Fair Drive, Costa Mesa, California PASSED AND ADOPTED this 16th day of February, 1968.
