HomeMy WebLinkAbout68-83 - Approving Property Trade - Harbor for Fair DriveRESOLUTION No. 68-83 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, RELATING TO THE TRADE OF CERTAIN CITY PROPERTY, FINDING THE NECESSITY FOR THE SAME, OVER -RULING PROTESTS AND APPROVING THE TRADE OF SAID PROPERTY. THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: THAT WHEREAS, the City has proceeded under and by virture of Title 4, Division 3, Article 3, Section 37420, et seq. of the Government Code for the sale or trade of certain property, the legal description of which is attached hereto marked Exhibit "A" and by this specific reference made a part hereof; and WHEREAS, the time for public hearing was f'_xed by resolution of intention tc be 7:30 p.m., December 2, 1968, in the City Council Chambers at 77 Fair Drive in the City of Costa Mesa, at which said 'gime and place any and all interested parties could appear and protest the proposed trade; and WHEREAS, the City Council having opened the public hearing, heard and considered all written and oral protests and having closed said public hearing in accordance with its established practices; 7■ J NOW, THEREFORE, BE IT RESOLVED that the City Council finds and declares that the posting and publication of notice to trade has been completed in accordance with Section 37423 of the Government Code. BE IT FURTHER RESOLVED that the protests, written and oral, are hereby over -ruled. BE IT FURTHER RESOLVED that the City Council finds and declares that it is in the best interest of the City of Costa Mesa that the herein described property be traded to the Southern California College for a parcel of property approximately ten acres in size, lying immediately south of Fair Drive and east of he present civic center site. BE IT FURTHER RESOLVED 'chat the City Counc'_L. o-_' the City of Costa Mesa finds and declares that when a trade is negotiated that the property to be acquired by the City of Costa Mesa will exceed in reasonable value the property owned by the city heretofore described in this resolution. BE IT FINALLY RESOLVED that the City Manager or his duly authorized argent be instructed to open such escrows as are necessary to accomplish the trade as set forth herein. City Clerk and ex -officio Clerk of the City Council_ of the City of Costa Mesa EXHIBIT 'A That portion of the land allotted to James McFadden by Final Decree of Partition of the Rancho Santiago de Santa Ana rendered September 12, 1868 in the First District Court of Los Angeles, California, Case No. 1192, described as follows: Beginning at the intersection of the northerly line of that certain parcel of land acquired by the State of California by deed recorded in Book 6248, page 583 of Official Records in the office of the County Recorder of said County, with a line that is parallel with and distant westerly 68.00 feet, measured at right angles from the center line of Harbor Boulevard, said center line being the easterly line of said certain parcel so acquired; thence along said parallel line South 00 20' 52" West, 103.17 feet to a tangent curve concave northwesterly and having a radius of 280.00 feet; thence southwesterly along said curve through an angle of 1090 08' 25", an are distance of 533.36 feet; thence North 700 30' 43" West, 250.40 feet; thence North 470 44' 05" West, 62.10 feet; thence North 650 20' 20" West, 150.16 feet; thence North 630 21' 27" West, 414.87 feet to said northerly line; thence along said northerly line South 890 34' 41" East, 1163-36 feet to the point of beginning, together with those certain access rights as said rights were acquired by said deed.
