RESOLUTION N0. 69-2
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA ORDERING THE VACATION OF A PORTION
OF HUNTZINGER AVENUE, BEING THE UNIMPROVED LINK
BETWEEN SUNFLOWER AVENUE IN COSTA MESA AND
ELLIS AVENUE IN FOUNTAIN VALLEY
WHEREAS, the City Council of the City of Costa Mesa did, on the
2nd day of December, 1968, pass and adopt its Resolution No. 68-85, entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA DECLARING ITS
INTENTION TO ORDER THE VACATION OF A CERTAIN PORTION OF HUNTZINGER AVENUE,
BEING THE UNIMPROVED LINK BETWEEN SUNFLOWER AVENUE IN COSTA MESA AND ELLIS
AVENUE IN FOUNTAIN VALLEY; and
WHEREAS, pursuant to said Resolution of Intention the time and
place for hearing all persons interested in or objecting to the proposed
vacation was set for Monday, the 6th day of January, 1969, at the hour of
7:30 o'clock P.M., in the Council Chamber at the City Hall, 77 Fair Drive,
Costa Mesa, California; and
WHEREAS, notices of said proposed vacation were duly and regu-
larly posted as required by law, all pursuant to the provisions of Division 9,
Part 3, Chapter 2 of the Streets and Highways Code of the State of California;
and
WHEREAS, said date of hearing coming on regularly to be
heard, all persons appearing on the proposed vacation were heard, and
said hearing was closed on the 6th day of January, 1969; and
WHEREAS, The City Council of the City of Costa Mesa finds and
determines, from all the evidence submitted, that the hereinafter described
right of way is unnecessary for present or prospective street purposes;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA
DOES ORDER AND RESOLVE AS FOLLOWS:
1. That the hereinafter described right of way is
unnecessary for present of prospective street purposes.
2. It is hereby ordered that the following described right
of way be, and the same is hereby vacated:
That portion of Huntzinger Avenue, being the unimproved
link between Sunflower Avenue in Costa Mesa and Ellis
Avenue in Fountain Valley, more particularly described
as follows:
A portion of that certain easement created by instrument
recorded June 9, 1904, in Book 103, page 378 of Deeds in
the office of the County Recorder of Orange County. Said
portion bounded westerly by the southeasterly line of
Parcel 1 in deed to the Southern California Edison Company
recorded July 24, 1956, in Book 3588, page 491 of said
official records, and bounded northeasterly by the
southwesterly line of the land described in deed to the
State of California, recorded September 14, 1962, in
Book 6248, page 587 of said official records.
EXCEPTING THEREFROM all easements of record and all easements for pipe
lines and other underground utility installations in place.
PASSED AND ADOPTED this 6th day of January, 1969.
