HomeMy WebLinkAbout69-04 - Order to Vacate Portions of Sparkes Street & Westminster AvenueRESOLUTION NO. 69-4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA ORDERING THE VACATION OF PORTIONS OF SPARKS STREET AND WESTMINSTER AVENUE IN THE CITY OF COSTA MESA WHEREAS, the City Council of the City of Costa Mesa did, on the 16th day of December, 1968, pass and adopt its Resolution No. 68-101, entitled; A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTAMESA DECLARING ITS INTENTION TO ORDER THE VACATION OF PORTIONS OF SPARKS STREET AND '.WESThIINSTERAVENUE AT THE MESA SHOPPING CENTER IN THE CITY OF COSTA MESA; WHEREAS, pursuant to said Resolution of Intention, the time and place for hearing all persons interested in or objecting to the proposed vacation was set for Monday, the 6th day of January, 1969, at the hour of 7:30 o'clock P. M., in the Council Chamber at the City Hall, 77 Fair Drive, Costa Mesa, California; and WHEREAS, notices of said proposed vacation were duly and regularly posted as required by law, all pursuant to the provisions of Division 9, Part 3, Chapter 2 of the Streets and Highways Code of the State of California; and WHEREAS, said date of hearing coming on regularly to be heard, all persons appearing on the proposed vacation were heard, and said hearing was continued to January 20, 1969, at the hour of 7:30 o'clock P. M., in the Council Chamber at the City Hall; and WHEREAS, the City Council of the City of Costa Mesa finds and determines, from all the evidence submitted, that the hereinafter described right of way is unnecessary for present or prospective street purposes; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES ORDER AND RESOLVE AS FOLLOWS: 1. That the hereinafter described right of way is unnecessary for present or prospective street purposes. 2. It is hereby ordered that the following described right of way be, and the same is hereby vacated, excepting therefrom right of way for existing utilities and access therefor: PARCEL I That portion of Spa rkes Street as shown on a map of Tract No. 590, recorded in Book 31, page 36, of Miscellaneous Maps, records of Orange County, California, lying southeasterly of a line parallel with and 460 feet southeasterly, measured along the northeasterly line of Lot 73, from the centerline of Orange Avenue, 60 feet wide, as shown on a map of Newport Heights recorded in Book 4, page 83, of Miscellaneous Maps of said Orange County. PARCEL 2 That portion of Westminster Avenue as shown on said map of Tract No. 590 lying northeasterly of the southeasterly prolongation of the southeasterly line of Lot 1 in said Tract No. 590, excepting therefrom any portion thereof previously vacated by resolution of the City of Costa Mesa, a certified copy of which was recorded December 3, 1968 in Book 4503, page 80 of Official Records of said Orange County. PARCEL 3 That portion of said Westminster Avenue as described in the easement deed to the City of Costa Mesa, recorded in Book 4503, page 7, of Official Records of said Orange County lying north- easterly of said southeasterly prolongation of the southwesterly line of Lot 1 in Tract No. 590.
