IN WITNESS WHEREOF, I have hereunto set my hand and affixed the Seal of the City of Costa Mesa, this 18th day of March, 1969. 77�//-������ City Clerk and ex -officio Clerk of the City Council of the City of Costa Mesa RESOLUTION NO. 69-25 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA APPROVING AN AGREEMENT BY AND BETWEEN THE DEPARTMENT OF FINANCE OF THE STATE OF CALIFORNIA AND THE CITY OF COSTA MESA FOR THE PREPARATION OF AN ESTIMATE OF POPULATION AND AUTHORIZING THE MAYOR AND CITY CLERK TO SIGN THE AGREEMENT. WHEREAS, there has been presented to the City Council of the City of Costa Mesa a certain agreement by and between the Department of Finance of the State of California, and the City of Costa Mesa, for the preparation of an estim;¢e.o£ population of said City; and WHEREAS, this Council deems it to be in the best interest of the City that said agreement, which is attached to and by this reference made a part of this Resolution, be approved, ratified and confirmed; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa Mesa that said agreement by and between said Department of Finance of the State of California and the City of Costa Mesa, for the preparation of an estimate of population of said City, be, and the same is hereby, approved, ratified and confirmed; and BE IT FURTHER RESOLVED, that the Mayor and City Clerk of the City of Costa Mesa are hereby authorized to execute said agreement on behalf of the City. IN WITNESS WHEREOF, I have hereunto set my hand and affixed the Seal of the City of Costa Mesa, this 18th day of March, 1969. 77�//-������ City Clerk and ex -officio Clerk of the City Council of the City of Costa Mesa Exhibit for: RESOLUTION N0. 69 - 26 Contract No. 1236 'H1•A AGREEMENT THIS AGREEMENT made and entered into this 16th day of Maro6 , 19 69 , at Sacramento, California, by and between DEPARTMENT OF FINANCE of the State of California, hereinafter called the Department, and the City of Costa loam hereinafter called the City: W I T N E S S 9 T H: WHEREAS, it is provided in Section 2107.2, Streets and Highways Code, that any city or city and county may apply to Department to estimate its population or the population of any inhabited territory annexed to the city subsequent to the last federal census, and WHEREAS, said Section 2107.2 provides that Department may make the estimate if in the opinion of Department there is available adequate information upon which to base the estimate, and WHEREAS, City desires to have Department estimate population of City and Department is willing to make such estimation, provided adequate information is available upon which to base the estimate, NOW, THEREFORE, it is hereby mutually agreed bet weeen the paroles hereto as follows: 1. City shall provide such data as are requested by Department in order that Department may determine whether adequate information is available upon which to base an estimate of population. In the event Department determines that adequate information upon which to base an estimate of population is not available it shall inform City and shall explain to City the basis for this determination and in such case Depart- ment may render no further services hereunder. However, should Depart - Form SD -115(b) Rev. 012268 Estimate A regular enumeration in - Page Two want determine that adequate information upon which to base an estimate of population can be developed Department agrees to proceed to perform such further work as it deams necessary in order to make an estimate of population and 1£ requested to do so by City, Department shall file a certified copy thereof. with the Controller pursuant to Section 2107.2, Streets and Highways Code. It is further mutually understood and agreed that Department shall have full and complete charge in the selection and application of the method or methods used in estimating the population of City and that City shall certify as to the accuracy of all information furnished from local records for use in preparation of said estimate of population. 2. If City is unable to provide adequate information upon which to base an estimate, the Department, at the request of city, may provide additional service directed toward the development of data for population estimating. Such service may include the design of procedures and provision of materials and data processing services for enumeration work carried out - under the administrative guidance of and at the expense of City. It is mutually understood that Department shall have full and complete charge in the design of the enumeration, definitions used, and interpretation of results although City will retain the right to include materials and questions of its choice subject only to final approval by the Department. 3. Within thirty (30) days after notification by Department to City of completion of such estimate of population, City agrees to reimburse Department for all costs incurred by Department in connection with the performance of .this agreement. (2) Where applicable, an additional cost per data card for materials, data processing and programming. (3) When available and at the City's request for permanent possession, a charge for data tapas. The standard scale of charges and the unit card charge are attached as Appendix A, which is by reference hereby made part of this Agreement. 4. Department shall furnish a statement to City of amount due from City as hereinabove provided upon the completion of the services to be rendered under this Agreement by Department and City agrees to pay Department the amount due as shown in such statement within 30 days after receiving such statement.
