A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, RELATING TO ANNEXATION OF CERTAIN TERRITORY KNOWN
AS BACK BAY NUMBER 1; PROVIDING FOR A RESOLUTION CALLING FOR A
SPECIAL ELECTION; DETERMINING THE SUFFICIENCY OF THE PETITION
REQUESTING SAID ELECTION; AND DETERMINING THE JURISDICTION OF
THE CITY TO PROCEED AS THE CONDUCTING AGENCY FOR SAID ANNEXATION.
THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DOES HEREBY
RESOLVE AS FOLLOWS:
THAT WHEREAS, certain petition or petitions requesting the annexa-
tion of territory to the City of Costa Mesa have been compiled and filed
pursuant to Section 35116 of the Government Code; and
WHEREAS, the City Council of the City of Costa Mesa finds and declares
that said petition or petitions are signed by not less than one-fourth of the
qualified electors residing within the territory to be annexed; and
WHEREAS, said petitions request annexation to the City of Costa
Mesa; and
WHEREAS, said petition or petitions are sufficient in all aspects
pursuant to Section 35116 of the Government Code; and
WHEREAS, the petition or petitions filed with the City of Costa
Mesa establish jurisdiction with said agency to conduct the annexation
herein provided for.
NOW, THEREFORE, BE IT RESOLVED THAT the City of Costa Mesa declares
its intention to call a special election and further declares its intention
to submit the question of annexation to the electors residing within the
territory.
BE IT FURTHER RESOLVED THAT the intention to submit the question of
annexation to the electors was based upon the finding that the petition or
petitions circulated and submitted to the City of Costa Mesa contain not less
than one-fourth of the qualified electors residing within the territory.
BE IT FURTHER RESOLVED, THAT the City of Costa Mesa has jurisdiction
as a conducting agency to proceed with said election, all as provided for
in Section 35116 of the Government Code of the State of California.
BE IT FURTHER RESOLVED, that attached hereto, marked Exhibit "A" and by
this specific reference made a part hereof, is a map showing the boundaries of
the property to be annexed, which said annexation shall be designated as
Back Bay No. 1.
BE IT FURTHER RESOLVED, THAT a hearing shall be set in not less
than fifteen (15) days nor more than forty (40) days after the passage
of this resolution and that said hearing is set for the lst day of
December, 1969, at the hour of 7:30 p.m., at the Council Chambers,
77 Fair Drive, Costa Mesa, California, at which time any person owning
real property within the territory may appear before the legislative
body concerning any written protests filed pursuant to Section 35120
of the Government Code.

officio Clerk of the City Council of the City of Costa Mesa, hereby
certify that the above and foregoing Resolution 69-74 was duly and
regularly passed and adopted by the City Council of the City of
Costa Mesa at a regular meeting thereof held on the 1st day of December,
1969.
