HomeMy WebLinkAbout69-81 - Calling Special Election - Back Bay No. 1 Annexation_.401A RESOLUTION NO. 69-81 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, CALLING A SPECIAL ANNEXATION ELECTION IN THE MATTER OF BACK BAY NO. 1 ANNEXATION. WHEREAS, a public hearing in the matter of Back Bay No. 1 Annexation has been held pursuant to law; and WHEREAS, this City Council finds and determines, by this Resolution, pursuant to Section 35121.1 of the Government Code, that a majority protest was not made, in accordance with Section 35121 of the Government Code, that in fact no written protests were made; and WHEREAS, this Council is desirous of proceeding with the said annexation; NOW, THEREFORE, the City Council of the City of Costa Mesa does hereby resolve as follows: SECTION 1. That a special election shall be held on the 3rd day of February, 1970, in certain inhabited territory contiguous to the City of Costa Mesa proposed to be annexed thereto, for the purpose of submitting to the qualified electors residing in said territory the question of whether or not said territory shall be annexed to the City of Costa Mesa. SECTION 2. That said territory is described as follows: A parcel of land lying within Tract No. 376, as shown on a map thereof, recorded in Book 15, page 2 of Miscellaneous Maps, records of Orange County, California, and Tract No. 456, as shown on a map thereof, re- corded in Book 17, page 9 of Miscellaneous Maps, records of said Orange County, more particularly described as follows: Beginning at an angle point in the existing boundary of the City of Costa Mesa, as said boundary is described in the official description of the original boundary in a Resolution of the Board of Supervisors of said Orange County, dated June 25, 1953, filed and accepted by the Secretary of State, State of California, on June 29, 1953, said angle point being the intersection of the southeasterly line of Santa Ana Avenue, 60 feet in width, with the northeasterly line of Mesa Drive, 60 feet in width, as shown on said Tract No. 456; thence north 50° 11' 34" west, along said existing boundary, 60.00 feet to the northwesterly line of said Santa Ana Avenue; thence departing from said existing boundary, north 39° 48' 45" east, along said northwesterly line of said Santa Ana Avenue, 630 feet to the northwesterly prolongation of the northeasterly line of Lot 9 of said Tract No. 456; thence south 50° 11' 45" east, along said northwesterly prolongation and the northeasterly line of said Lot 9 and the northeasterly line of Lot 16 of said Tract No. 456, 525.00 feet to the northwesterly line of the southeasterly one-half of Lot 15 of said Tract No. 456; thence north 39° 48' 45" east, along said northwesterly line, 294 feet; thence south 50° 11' 45" east, 165 feet to the southeasterly line of said Lot 15; thence south 39° 48' 45" west, along said southeasterly line, 294 feet to the northeasterly line of said Lot 16; thence south 50" 11' 45" east along the northeasterly line of Lot 17 and Lot 20 of said Tract No. 456, 766.32 feet, to a point in the northwesterly right of way line of Tustin Avenue, 90 feet in width, as described in a deed to the County of Orange, recorded March 11, 1969, in Book 8896, pages 117 through 120 of Official Records of said Orange County, said point being in a non -tangent curve, concave southeasterly, having a radius of 1050.00 feet, a radial line to said point bears north 18° 33' 57" west; thence south 18° 73' 57" east, 90.00 feet to a point in the southeasterly right of way line of said Tustin Avenue, said point being in a non -tangent curve, concave southeasterly, having a radius of 960.00 feet; thence southwesterly along said curve and said southeasterly right of way line, through a central angle of 31° 37' 18", an arc distance of 529.83 feet to a tangent line; thence south 39° 48' 45" west, along said tangent line and said southeasterly right of way line and the southwesterly prolonga- tion thereof, 140.00 feet to a point in the southwesterly right of way line of Mesa Drive, 60 feet in width, as said Mesa Drive is shown upon a map of Tract No. 706, recorded in Miscellaneous Map Book 21, page 25, records of said Orange County, said point being in the boundary of the City of Newport Beach, as said boundary is described in the Upper Bay Annexation to the City of Newport Beach, adopted May 24, 1955, by Ordinance No. 748; thence north 50° 11' 45" west along said existing boundary, 10.00 feet to an angle point in said boundary, said angle point being the intersection of the southwesterly line of said Mesa Drive with the southeasterly line of said Tustin Avenue; thence south 39° 48' 45" west, along said existing boundary of the City of Newport Beach and the southeasterly right of way line of said Tustin Avenue, 630.00 feet to the southeasterly prolongation of the southwesterly line of Lot 81 of said Tract No. 376; thence north 50° 11' 45" west departing from said existing boundary of the City of Newport Beach along said southeasterly prolongation and the south- westerly line of Lots 819 76 and 75 of said Tract No. 376, a distance of 1320.00 feet to the previously mentioned southeasterly line of said Santa Ana Avenue and previously mentioned existing boundary; thence north 39° 48' 45" east, along said southeasterly line and said existing boundary, 690.00 feet to the point of beginning. SECTION 3. That said territory is hereby designated and identified as "BACK BAY NO. I ANNEXATION." SECTION 4. That the City Clerk is hereby instructed and directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct said election. SECTION 5. That the ballots to be used at said election shall be, both as to form and matter contained therein, such as may be required by law to be used thereat. SECTION 6. That upon the ballots to be used at said election there shall be printed the words: SHALL "BACK BAY NO. 1 ANNEXATION" BE ANNEXED TO THE CITY OF COSTA MESA? Opposite those words shall be printed the words "Yes" and "No", and to the right of each of those last two words there shall be a voting square. If an elector shall stamp a cross (+) in the voting square after the printed word "Yes" the vote of such elector shall be counted in favor of the annexa- I tion of said territory to the City of Costa Mesa; and if an elector shall stamp a cross (+) in the voting square after the printed word "NO" the vote of such elector shall be counted against such annexation. SECTION 7. That for the purpose of holding said special annexation election, there shall be one voting place established for holding the election, designated as follows: POLLING PLACE: Crane Residence (Garage) 2681 Redlands Drive INSPECTOR: Marcella J. Crane, 2681 Redlands Drive JUDGE: Frances H. Shipley, 2686 Redlands Drive CLERK: Frances L. Coleman, 2657 Riverside Drive CLERK: Donna Anderson, 2680 Redlands Drive SECTION 8. That all of the persons hereinabove named as election officers are hereby appointed as such election officers, respectively, and their compensation is hereby fixed at the sum of $21.00 for the Inspector and $18.00 for each Judge and Clerk for said election. SECTION 9. That the polls for said election shall be open at seven o'clock a.m, of the day of said election, and shall remain open continuously from said time until seven o'clock p.m. of the same day when said polls shall be closed,except as provided for in Section 14436 of the Elections Code of the State of California. SECTION 10. That in all particulars not recited in this Resolution, said election shall be held and conducted as provided by law for holding annexation elections in said City. SECTION 11. That notice of the time and place of holding said election is hereby given, and the City Clerk is hereby authorized, instructed and directed to give such further or additional notice of said election in time, form and manner as required by law. SECTION 12. That the City Clerk shall certify to the passage and adoption of this resolution, shall enter the same in the book of original resolutions of said City, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of themeeting at which the same is passed and adopted. SECTION 13. That this resolution shall take effect immediately.
