HomeMy WebLinkAbout70-84 - Establishing Underground Utility District No. 3912 RESOLUTION NO. 70-84 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 3. THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, a public hearing was called for Monday, September 21, 1970, at the hour of 7:30 p.m. in the Council Chambers in the City Hall, Costa Mesa, I� California, to ascertain whether the public necessity, health, safety, or welfare requires the removal of poles, overhead wires and associated over- head structures, and the underground installation of wires and facilities for supplying electrical, communication, or similar or associated service, within that certain area of the City described as follows: A strip of land 100.00 feet wide centered on the centerline of Harbor Boulevard extend- ing from a line 50.00 feet North of the centerline of 19th Street to a point 40.00 feet North of the centerline of Wilson Street and the area included within the following described line: Beginning at a point 40.00 feet North of the centerline of Wilson Street and 60.00 feet West of the centerline of Harbor Boulevard; thence Easterly from said point, running parallel with and 40.00 feet Northerly of the centerline of Wilson Street to the Westerly line of Lot 1, Tract No. 9 of Miscellaneous Maps, Book 9, page 9; then Northerly along the Westerly line of said Lot 1, to the Northerly line of Lot 1; then Easterly along said Northerly line to a point 5.00 feet West of the Westerly line of Tract No. 2750, Miscellaneous Maps, Book 91, page 1 through 5 inclusive; thence Northerly along a line 5.00 feet West of said Westerly tract line to a point 50.00 feet South of the centerline of Fair Drive; then Westerly on a line parallel i with and 50.00 feet Southerly of the centerline of Fair Drive Jr to a point 60.00 feet East of the centerline of Harbor Boulevard; then Northerly on a line parallel with and 60.00 feet Easterly of the centerline of Harbor Boulevard to the South line of Tract No. 2727 as described in Miscellaneous Maps, Book 87 pages 34 and 35; then Westerly along said Southerly line to the Westerly line of said tract which lies 50.00 feet East of the centerline of Harbor Boulevard; then Northerly along Westerly line of said tract to a point 5.00 feet North of the Northerly line of Tract 2727; thence Easterly on a line parallel with and 5.00 feet North of the Northerly line of said Tract No. 2727 to the Southerly extension of the centerline of Banana Street as shown on a map of Fairview Tract recorded in Book 25, page 76, Miscellaneous Maps, of Los Angeles County; thence Northerly along said centerline of Banana Street to the South line of Adams Avenue (120.00 feet wide); then Easterly along said South line to the Westerly line of Fairview Road (50.00 feet from the centerline of Fairview Road); then Northerly along said Westerly line to the Northerly line of Adams Avenue (120.00 feet wide); then Westerly along said Northerly line to the Westerly line of Harbor Boulevard (68.00 feet West of the centerline of Harbor Boulevard); then Southerly along said Westerly line to the South line of Adams Avenue (56.00 feet South of the centerline of Adams Avenue); then Westerly along said South line 122.00 feet to a point in a line 190.00 feet West of the centerline of Harbor Boulevard; then Southerly along said line to the South line of the Banning Tract, recorded in Book 3, pages 160 and 162 of Miscellaneous Maps, of Los Angeles County; then Easterly 130.00 feet to the Westerly line of Harbor Boulevard (60.00 feet West of the center- line); then Southerly along said Westerly line to the point of beginning. 'A3 WHEREAS, WHEREAS, notice of such hearing has been given to all affected property owners as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and within the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa Mesa, that, pursuant to Ordinance No. 68-21 of the City of Costa Mesa, the above described area is hereby declared an Underground Utility District, and is designated as Underground Utility District No. 3 of the City of Costa Mesa. Attached hereto, marked "Exhibit A," and hereby incorporated as part of this resolution, is a map delineating the boundaries of said District; RESOLVED, FURTHER, that the Council does hereby fix February 1, 1972, as the date on which affected property owners must be ready to receive underground service, and does hereby order the removal of all poles, over- head wires and associated overhead structures and the underground instal- lation of wires and facilities for supplying electrical, communication, or similar or associated service within Underground Utility District No. 3 on or before April 1, 1972; RESOLVED, FURTHER, that the following exception in said Underground Utility District No. 3 be and they are hereby authorized: (1) Any municipal facilities or equipment installed under the super- vision and to the satisfaction of the City Engineer. (2) Poles or electroliers used exclusively for street lighting (or traffic signals). (3) Overhead wires (exclusive of supporting structures) crossing any portion of a District within which overhead wires have been prohibited, or connecting to buildings on the perimeter of a District, when such wires originate in an area from which poles, overhead wires and associated overhead structures are not pro- hibited. (4) Poles, overhead wires and associated overhead structures used for the transmission of electric energy at nominal voltages in excess of 34,500 volts. (5) Antennae, associated equipment and supporting structures, used by a utility for furnishing communication services. (6) Equipment appurtenant to underground facilities, such as surface mounted transformers, pedestal mounted terminal boxes and meter cabinets, and concealed ducts. (7) Temporary poles, overhead wires and associated overhead structures used or to be used in conjunction with construction projects. RESOLVED, FURTHER, that the City Clerk is hereby instructed to notify all affected utilities and all persons owning real property within Underground Utility District No. 3 of the adoption of this resolution within ten (10) days after the date of such adoption. Said City Clerk shall further notify said property owners of the necessity that, if they or any person occupying such property desire to continue to receive electric, communication or other similar or associated service, they or such occupant shall, by the date fixed in this resolution, provide all necessary facility changes on their premises so as to receive such service from the lines of the supplying utility or utilities at a new location, subject to applicable rules, regulations and tariffs of the respective utility or utilities on file with the Public Utilities Commission of the State of California. Such notification shall be made by mailing a copy of this resolution together with a copy of said Ordinance No. 68-21, to all affected property owners as such are shown on the last equalized assessment roll and to the affected utilities; :144 RESOLVED, FURTHER, that the Council hereby finds and determines as follows: The Underground Utility District herein created is in the general public's interest for the following reasons: (1) The undergrounding to be accomplished will avoid or eliminate an unusually heavy concentration of overhead distribution facilities; (2) The streets, roads or rights of way in the District are extensively used by the general public and carry a heavy volume of pedestrian or vehicular traffic.
