HomeMy WebLinkAbout70-07 - Ordering Territory Annexed - Whittier HeightsRESOLUTION NO. 70-7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING AND ORDERING CERTAIN TERRITORY ANNEXED TO THE CITY OF COSTA MESA, CALIFORNIA, WITHOUT HEARING OR ELECTION. THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the Local Agency Formation Commission of Orange County, California, did on the 14th day of January, 1970, approve the annexation of certain territory described as Whittier Heights Annexation to the City of Costa Mesa, after application having been made for said annexation by the City of Costa Mesa and accompanied by written consent of 100% of the land owners within the territory. NOW, THEREFORE, the City Council of the City of Costa Mesa, California, finds and determines as follows: (a) That the territory proposed to be annexed is uninhabited and that no written protests have been filed and that the written protests filed and not withdrawn represent less than ten percent of the number of land owners in the territory proposed to be annexed, owning not more than ten percent of the assessed value of land therein. (b) That the proposed annexation will be for the interest of the land owners and the present and future inhabitants within the territory proposed to be annexed. (c) That the City Council has taken into consideration as a factor, in addition to the factors hereinabove set forth, the Local Agency Formation Commission's approval of the proposed annexation. (d) That the territory proposed to be annexed is contiguous to the existing boundaries of the City of Costa Mesa and is not, nor is any part thereof, included in any other city orsimilar purpose, having been detached from the City of Newport Beach. The City Council has hereby ordered the annexation of Whittier Heights in accordance with Section 56320 and 56322, inclusive of the Government Code of the State of California. That the exterior boundaries of the territory annexed are as set forth in a map and legal description attached hereto marked Exhibit "A" and by this reference made a part hereof. 1�� PASSED AND ADOPTED this 2nd day of February, 1970. IN WITNESS WHEREOF, I have here$ set my Paxdhand affixed the Seal of the City of Costa Mesa, this r day of Fe rucarp, 1970. <9'111J 6• Acting City Clerk and ex -officio Clerk the City Council of the City of Cos V Mesa -12 -At DESCRIPTION WHITTIER HEIGHTS ANNEXATION TO THE CITY OF COSTA MESA Resolution 70 - 07 Exhibit "A" Beginning at a point in the existing boundary of the City of Costa Mesa, as said boundary is described in Mesa No. 2 Annexation to the City of Costa Mesa, adopted December 3, 1956, Ordinance No. 149, said point being a point in the northerly boundary of said Mesa No. 2 Annexation, said point being distant South 00 18' West, 330.00 feet from the center line of 19th Street, said point also being the southeasterly corner of Lot 1201, First Addition to Newport Mesa Tract, as shown on a map thereof, recorded in book 8, page 61 of Miscellaneous Maps, records of Orange County, California; thence South 891 42' West, along said existing boundary and the southerly line of Lot 1201, 630.00 feet, to the southwesterly corner of said Lot 1201; thence North 00 18' East, along said existing boundary and the westerly line of said Lot 1201, 300.00 feet to the southerly line of 19th Street, as shown on said map of First Addition to Newport Mesa Tract; thence South 890 42' West, along said southerly line of 19th Street and said existing boundary, 270.44 feet to the northwesterly corner of Lot 1301 of said First Addition to Newport Mesa Tract, said northwesterly corner being a point in the existing, boundary of the City of Newport Beach; thence North 191 16' East, departing from said existing boundary of the City of Costa Mesa, along the northwesterly line of said First Addition to Newport Mesa Tract, 31.72 feet to a point in the northerly line of said First Addition to Newport Mesa Tract; thence North 890 42' East, along said northerly line, 590.13 feet; thence North 00 18' East, 30.00 feet to a point in the existing boundary of the City of Costa Mesa, as described in Republic No. 1 Annexation to said City, adopted March 15, 1954, Ordinance No. 389 said point being in a line, parallel with and 30.00 feet northerly, measured at right angles, of the northerly line of said First Addition to Newport Mesa Tract; thence North 890 42' East, along said parallel line and said existing boundary, 330.00 feet to its intersection with the northerly prolongation of the center line of Whittier Avenue as shown on said map of First Addition to Newport Mesa Tract; thence South 0" 18' West, along, said existing boundary said prolongation, and said center line of Whittier Avenue, 60.00 feet to a point in a line lying parallel with and 30.00 feet southerly, measured at right angles, of the northerly line of said First Addition to Newport Mesa Tract, said point also being an angle point in the existing boundary of Resolution No. 70 - 07 ( Exhibit A Cont. } the City of Costa Mesa, as said boundary is described in Mesa No. 1 Annexation to said City, adopted ,Tune 4, 1956, Ordinance No. 129; thence South 890 42' West, along said existing boundary and said parallel line, 30.00 feet to a point in the northerly prolongation of the westerly line of said Whittier Avenue; thence South 00 18' West, along said northerly prolongation said westerly line of Whittier Avenue, and said existing boundary of the City of Costa Mesa, 300.00 feet to the point of beginning.
