HomeMy WebLinkAbout70-09 - Making Application to Local Agency Formation Commission for Sewell Annex(Replacing Resolution No. 70-8) RESOLUTION NO. 70-9 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, MAKING APPLICATION TO THE LOCAL AGENCY FORMATION COMMISSION OF ORANGE COUNTY, CALIFORNIA, FOR THE ANNEXATION OF TERRITORY TO THE CITY. THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the City Council of the City of Costa Mesa, California, desires to initiate proceedings for the annexation of the hereinafter described territory to said city; NOW, THEREFORE, the City Council of the City of Costa Mesa, California, does hereby resolve, determine and order as follows: 1. That this application is being filed pursuant to the provisions of Division 1 of Title 6 of the Government Code of the State of California for the purpose of proposing an annexation of the below described territory to the City of Costa Mesa. 2. That the territory proposed to be annexed contains seven - eighths of one acre and is contiguous to the City of Costa Mesa and the territory proposed to be included in and annexed to said City is specifically described in Exhibit "A" which is attached hereto and made a part hereof, consisting of one typewritten sheet and a map. 3. That a map showing said boundariestogether with a copy of the above legal description has heretofore been filed with the Orange County Surveyor and with the Commission and has been found to be definite and certain by the Orange County Surveyor. Said map is hereby referred to, and by reference made a part hereof, to the same force and effect as if set out herein or attached hereto. 4. That the territory proposed to be annexed is uninhabited. 5. That the reason for the proposed annexation is that the territory is ready for development and that City services are necessary for the protection of health, safety and welfare of the developers and that the City of Costa Mesa is the agency most feasible to provide said facilities to said area. 6. That the territory proposed to be annexed is entirely located within the County of Orange, California. 7. That the names of all the affected districts are as follows: County Sanitary District No. 7 Orange County Flood Control District Harbor District Mosquito Abatement District County Library District Metropolitan Water District Santa Ana School District 8. That the City Council of the City of Costa Mesa respectfully requests the Local Agency Formation Commission of Orange County, California, to institute proceedings for the annexation of the above described territory to said city. 9. That it is further requested that the said Local Agency Formation Commission order pursuant to the provisions of Section 56261 of the Government Code of California that this annexation be approved without notice and hearing by the commission and approve and authorize the City Council of the City of Costa Mesa to annex such territory without notice and hearing by the City Council and without an election. 10. That attached hereto is evidence of consent and request directed to the City Council of the City of Costa Mesa signed by all of the owners of the land within such territory proposed to be annexed. 11. That the owners who signed said attached consent and request are hereby found to be the owners of 100% of the land described above. 12. That the proposed terms and conditions to which the proposed annexation is desired to be subject are described as follows: That all annexation fees be paid to the City prior to this annexation becoming effective. Mesa B E S C R I P T I 0 N Exhibit "A" Proposed Annexation to the City of Costa Mesa All that certain land situated in the State of California, County of Orange, described as follows: Being a portion of Lot 226 of Newport Heights, as shown on a Map thereof, Recorded in Book 4, page 83 of Miscellaneous Maps, Records of Orange County, California, more particularly described as follows: BEGINNING at the centerline intersection of Tustin Avenue and Twentieth Street, as shown On said map of Newport heights; thence along said centerline of Tustin Avenue, North 400 Beat, 330.15 feet to the Southeasterly prolan Cat ion of the Southwesterly line of said Lot 226; thence along said Southeasterly prolonga- tion, North 500 West, 30.00 feet to the most Southerly corner of said Lot 226, said point being also in the Northwesterly line of said Tustin Avenue, and said point being also in the existing boundary line of the city of Costa Mesa, a- described in the Underwood Annexation to said city of Costa Mesa, adopted July 17, 195 8, by Ordinance No. 205, and said point being also the True Point of Beginning of this description; thence along the Southwesterly line of said Lot 226, North 500 West, 315.00 feet to a line parallel with and distant 315.00 feet, as measured at right angles, from said Northwesterly right-of-way line of `Tustin Avenue; thence along said parallel line, North 400 East, 132.15 feet to a line parallel with and distant 198.00 feet, as measured at right angles, fron the Northeasterly line of said Lot 226; thence along said parallel line, South 500 East, 315.00 feet to said Northwesterly right-of-way line of Tustin Avenue, said point being also in said existing boundary line of the city of Costa Mesa; thence along said Northwesterly right-of-way line of Tustin Avenue and along said existing boundary line of the city of Costa Mesa, South 400 West, 132.15 feet to the True Point of Beginning.
