HomeMy WebLinkAbout70-44 - To LAFC - Sewell Annexation to Park and Recreation DistrictIS RESOLUTION NO. 70-44 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE COSTA MESA RECREATION AND PARK DISTRICT, ORANGE COUNTY, CALIFORNIA, TO THE LOCAL AGENCY FORMATION COMMISSION FOR THE ANNEXATION OF TERRITORY, KNOWN AS "SEWELL ANNEXATION." THE BOARD OF DIRECTORS OF THE COSTA MESA RECREATION AND PARK DISTRICT, DOES HEREBY RESOLVE AS FOLLOWS: (a) That the legal description of the proposed Sewell Annexation was presented to the Local Agency Formation Commission for checking by the County Surveyor to determine whether the boundaries are reasonably definite and certain; and (b) That the Board of Directors of the Costa Mesa Recreation and Park District does hereby find and determine: 1. That the property proposed to be annexed to the Costa Mesa Recreation and Park District is uninhabited, is contiguous to the boundaries of the City of Costa Mesa. 2. That the territory to be annexed is designated as Sewell Annexation and the legal description of the property is as follows: Being a portion of Lot 226 of Newport Heights, as shown on a Map thereof, Recorded in Book 4, page 83 of Miscellaneous Maps, Records of Orange County, California, more particularly .described as follows: Beginning at the centerline intersection of Tustin Avenue and Twentieth Street, as shown on said map of Newport Heights; thence along said center- line of Tustin Avenue, North 40' East, 330.15 feet to the Southeasterly prolongation of the Southwesterly line of said Lot 226; thence along said Southeasterly prolongation, North 50o West, 30.00 feet to the most Southerly corner of said Lot 226, said point being also in the North- westerly line of said Tustin Avenue, and said point being also in the existing boundary line of the City of Costa Mesa, as described in the Underwood Annexation to said City of Costa Mesa, adopted July 17, 1958, by Ordinance No. 205, and said point being also the True Point of Beginning of this description; thence along the Southwesterly line of said Lot 226, North 500 West, 315.00 feet to a line parallel with and distant 315.00 feet, as measured at right angles, from said North- westerly right-of-way line of Tustin Avenue; thence along said parallel line, North 40' East, 132.15 feet to a line parallel with and distant 198.00 feet, as measured at right angles, from the Northeasterly line of said Lot 226; thence along said parallel line, South 50' East, 315.00 feet to said Northwesterly right-of-way line of Tustin Avenue, said point being also in said existing boundary line of the City of Costa Mesa; thence along said Northwesterly right-of-way line of Tustin Avenue and along said existing boundary line of the City of Costa Mesa, South 40o West, 132.15 feet to the True Point of Beginning. SUBJECT TO: All Covenants, Rights, Rights -of -Way and Easements of Record. 3. That the reason for the proposed annexation is that the terri- tory is ready for development and that parks and recreation services are necessary for the protection of health, safety and welfare of the developers and that the City of Costa Mesa Recreation and Park District is the agency most feasible to provdde said facilities to said area. 7.9 4. That there are no special terms or conditions to the proposed annexation. 5. That attached hereto and made a part of this Resolution is Exhibit "A", a legal description, and Exhibit "B", a map, of the territory proposed to be annexed. 6. That all notices with respect to hearings should be mailed to the following persons: A. R. McKenzie, City Manager, 77 Fair Drive, Costa Mesa, California. Roy E. June, City Attorney, 1500 Adams, Suite 206, Costa Mesa, California. Don Stevens, City of Costa Mesa Engineer, 116 East 18th Street, Costa Mesa, California.
