RESOLUTION NO. 70-52
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, REQUESTING THE DISCONTINUANCE OF NEGOTIATIONS
ON THE UPPER BAY LAND EXCHANGE.
WHEREAS, the City of Costa Mesa is vitally concerned about the Upper
Bay Land Exchange as there are yet many unanswered questions which must be
answered before further negotiations are conducted; and
WHEREAS, the City of Costa Mesa is desirous of information concerning
the exact status of North Star Beach and North Star Road; and
WHEREAS, the City of Costa Mesa desires to know the legal status of
Back Bay Drive which touches the tidelands in some 13 or 14 points; and
WHEREAS, from an ecological standpoint, the significance of this land
exchange should be thoroughly investigated and understood; and
WHEREAS, a method should be determined to properly channel the tide
waters to prevent stagnation and pollution if development is allowed to
proceed and, further, it should be determined whether another opening to
the ocean is needed to allow for this tidal change; and
WHEREAS, since the Back Bay is the headwater area of some 145 square
miles of water shed, study should be made concerning this runoff (river)
to show how this can be taken care of in the future.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa
Mesa that the Orange County Board of Supervisors is hereby requested
to discontinue immediately all negotiations for the Upper Bay Land Exchange
between the County of Orange and the Irvine Company; and
r BE IT FURTHER RESOLVED that this Council requests the Board of Supervisors
of Orange County to authorize a complete and detailed study in connection
with this exchange to obtain all the pertinent facts and answers to the many
unanswered questions so that the Board can make a reasonable and equitable
decision on this very important and vital issue.
