RESOLUTION NO. 70-79
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE VACATION OF
A PORTION OF SMALLEY ROAD IN TRACT 6245 BETWEEN SALINAS AVENUE
AND REDDING STREET.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Costa Mesa does hereby declare
its intention to vacate a portion of Smalley Road described as follows:
That portion of the land allotted to James McFadden in Decree of
Partition of the Rancho Santiago De Santa Ana, rendered in Case
No. 1192 and entered September 12, 1868, in Book B, Page 410 of
Judgments of the 17th Judicial District Court of California, in
the City of Costa Mesa, County of Orange, State of California,
described as follows:
Beginning at the centerline intersection of Salinas Avenue and
Smalley Road as said intersection is shown on a map of Tract
No. 6638 recorded in Book 256, Pages 5 and 6 of Miscellaneous
Maps, Records of Orange County, thence South O'Sl'10" West along
the centerline of Smalley Road and the easterly boundary of said
Tract No. 6638, 15.00 feet to a point on a curve concave north-
westerly and having a radius of 75.00 feet, a radial line to
said point bears South 37°43'23" East, said point being the true
point of beginning; thence South 051'10" West along the center-
line of Smalley Road 475.00 feet; thence at right angles to said
centerline, South 89°09'50" a distance of 25.00 feet; thence
North 0°51'10" West 462.72 feet to a point on the southerly
boundary of said Tract No. 6638, said point lying on a curve
concave northwesterly having a radius of 75.00 feet, a radial
line to said point bears South 16°19'09" East, thence northeasterly
28.02 feet along said curve through a central angle of 21°24'14"
to the true point of beginning.
SECTION 2. Monday, the 5th day of October, 1970, at the hour of 7:30 p.m.,
in the Council Chamber at the City Hall, 77 Fair Drive, Costa Mesa, California,
is hereby fixed as the time and place for hearing all persons interested in or
objecting to the proposed vacations.
SECTION 3. These proceedings shall be conducted pursuant to the provisions
of Chapter III, Part 3, Division 9 of the Streets and Highways Code of the State
of California.
SECTION 4. The City Manager of the City of Costa Mesa is hereby directed
to cause notices of the said proposed vacations to be conspicuously posted
along said strips of land for at least ten (10) days before the date of said
hearing. Said notices shall be posted not more than three hundred (300) feet
apart, but in no event shall less than three (3) notices be posted.
SECTION 5. This resolution shall be published once in the ORANGE COAST
DAILY PILOT, a newspaper of general circulation printed and published in the
City of Costa Mesa, Orange County, California.
PASSED AND ADOPTED this 8th day of September, 1970.
