RESOLUTION NO. 70-90
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, ORDERING THE VACATION OF A PORTION OF SMALLEY
ROAD IN TRACT 6245 BETWEEN SALINAS AVENUE AND REDDING STREET.
WHEREAS, pursuant to said Resolution of Intention the time and place
for hearing all persons interested in or objecting to the proposed vacation
was set for Monday, the 5th day of October, 1970, at the hour of 7:30 p.m.,
in the Council Chamber of the City Hall, 77 Fair Drive, Costa Mesa, California;
and
WHEREAS, notices of said proposed vacation were duly and regularly posted
as required by law, all pursuant to the provisions of Division 9, Part 3,
Chapter 2 of the Streets and Highways Code of the State of California; and
WHEREAS, said date of hearing coming on regularly to be heard, all
persons appearing on the proposed vacation were heard, and said hearing was
closed on the 5th day of October, 1970; and
WHEREAS, the City Council of the City of Costa Mesa finds and determines,
from all the evidence submitted, that the hereinafter described right of way
is unnecessary for present or prospective street purposes;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES ORDER
AND RESOLVE AS FOLLOWS:
1. That the hereinafter described right of way is unnecessary for present
or prospective street purposes.
2. It is hereby ordered that the following described right of way be,
and the same is hereby vacated:
That portion of land alloted to James McFadden in Decree of
Partition of the Rancho Santiago De Santa Ana, rendered in Case
No. 1192 and entered September 12, 1868, in Book B, Page 410 of
Judgements of the 17th Judicial District Court of California, in
the City of Costa Mesa, County of Orange, State of California,
described as follows:
Beginning at the centerline intersection of Salinas Avenue and
Smalley Road as said intersection is shown on a map of Tract No. 6638,
recorded in Book 256, Pages 5 and 6 of Miscellaneous Maps, Records
of Orange County; thence South 0'51'10" West along the centerline
of Smalley Road and the easterly boundary of said Tract No. 6638,
15.00 feet to a point on a curve concave northwesterly and having
a radius of 75.00 feet, a radial line to said point bears South
37°43'23" East, said point being the true point of beginning; thence
South 0°51'10" West along the centerline of Smalley Road 475.00
feet; thence at right angles to said centerline, South 89°08'50" a
distance of 25.00 feet; thence North 0°51'10" West 462.72 feet to
a point on the southerly boundary of said Tract No. 6638, said
point lying on a curve concave northwesterly having a radius of
75.00 feet, a radial line to said point bears South 16"19'09" East;
thence northeasterly 28.02 feet along said curve through a central
angle of 21°24'14" to the true point of beginning.
WHEREAS,
the City
Council of the City of Costa Mesa did, on the 8th
day of September, 1970,
pass and adopt Resolution No. 70-79, entitled: A
RESOLUTION OF
THE CITY
COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA,
DECLARING ITS
INTENTION
TO ORDER TEE VACATION OF A PORTION OF SMALLEY ROAD
IN TRACT 6245
