HomeMy WebLinkAbout71-07 - Setting Weed Abatement Public Hearing,09 RESOLUTION NO. 71-7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DETERMINING AND DECLARING THAT WEEDS WHICH BEAR SEEDS OF DOWNY OR WINGY NATURE AND WEEDS WHICH ATTAIN SUCH A LARGE GROWTH AS TO BECOME A FIRE NUISANCE WHEN DRY AND WEEDS WHICH ARE OTHERWISE NOXIOUS OR DANGEROUS ARE GROWING UPON CERTAIN STREETS, SIDEWALKS, PARKWAYS AND PRIVATE PROPERTY IN THE CITY OF COSTA MESA AND THAT THE SAME ARE A PUBLIC NUISANCE; DIRECTING THE STREET SUPERINTENDENT TO POST NOTICES TO DESTROY SAID WEEDS AS REQUIRED BY LAW FIXING THE TIME FOR HEARING ALL OBJECTIONS OR PROTESTS AND DIRECTING THE ABATEMENT THEREOF IN ACCORDANCE WITH ARTICLE 3 OF CHAPTER V OF THE MUNICIPAL CODE OF THE CITY OF COSTA MESA. WHEREAS, it has come to the attention of the City Council of the City of Costa Mesa that certain weeds more particularly described below are growing upon certain streets, sidewalks, parkways and private property in the City of Costa Mesa and that the same are a public nuisance; and WHEREAS, it appears to the City Council of the City of Costa Mesa that said weeds should be abated as a public nuisance in accordance with the pro- visions of Article 3 of Chapter V of the Municipal Code of the City of Costa Mesa; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: SECTION 1. Pursuant to the provisions of Article 3 of Chapter V of the Municipal Code of the City of Costa Mesa, the City Council of the City of Costa Mesa hereby determines and declares that weeds which bear seeds of a downy or wingy nature, and weeds which attain such large growth as to become a fire nuisance when dry and weeds which are otherwise noxious or dangerous, are growing upon certain streets, sidewalks, parkways and private property in said City as more particularly described hereinafter, and that the same are hereby declared to be a public nuisance, and that the names of such streets as they are commonly known are hereinafter set forth, and that the property fronting upon said streets, sidewalks or parkways, or in front of which such nuisance exists, are hereinafter described in accordance with the map used in describing the property for taxation purposes. SECTION 2. The Street Superintendent of the City of Costa Mesa, who, for the purposes of said Article 3 of Chapter V of the Municipal Code, is the City Manager of the City of Costa Mesa, is hereby designated as the person to give notice to destroy such weeds, said notice to be in accordance with the terms of Sections 5308 and 5309 of said Municipal Code; said City Manager, acting as Street Superintendent, is hereby instructed and desig- nated to prepare and post notices to destroy said weeds as required by law. Said notices shall be conspicuously posted on or in front of the property on which or in front of which the nuisance exists, or, if the property has no frontage upon any street, highway or road, then upon the portion of the property next to a street, highway or road most likely to give actual notice to the owner. Said notices shall be posted one notice to each piece or parcel of property in separate ownership of not over fifty (50) feet frontage, or not more than two notices to any such parcel of property in separate owner- ship with a frontage of one hundred (100) feet or less. If the frontage of any piece or parcel of property in separate ownership is greater than one hundred (100) feet, said notices shall be posted at not more than one hundred (100) feet in distance apart. Said notices shall be posted at least five (5) days prior to the time for hearing of objections, and post card notices of the hearing shall be mailed by the City Manager, acting as Street Superintendent, to such owners as have filed with the City Clerk a written request for such post card notices within one year prior to the date of mailing. SECTION 3. The City Council does hereby fix the lst day of March, 1971, at the hour of 7:30 p.m., as the time, and the Council Chamber in the City Hall, 77 Fair Drive, Costa Mesa, California, as the place for hearing objections and protests to the proposed removal of such weeds.
