RESOLUTION NO. 71-8
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, PLEDGING COOPERATION TO THE CALIFORNIA REGIONAL
WATER QUALITY CONTROL BOARD, SANTA ANA REGION, IN THE NOTIFI-
CATION OF THE FILING OF DEVELOPMENTS WHICH INVOLVE MAJOR
WASTE DISCHARGE.
WHEREAS, the Porter -Cologne Quality Control Act passed by the California
Legislature in November, 1969, offers an effective method for State and local
entities to cooperatively assure protection against water quality degradation
resulting from waste discharges from new land developments; and
WHEREAS, the California Regional Water Quality Control Board will imple-
ment the provisions of Section 13266 of the California Water Code, requiring
that all cities and counties within the Santa Ana Region notify the Board of
all applications for land development which could result in major discharge
of waste; and
WHEREAS, Section 11551.6 of the Business and Professions Code requires
cities and counties to determine whether discharge of waste from a proposed
subdivision into an existing community sewer system would result in violation
of existing waste discharge requirements adopted under Division 7 of the
Water Code; and
WHEREAS, the City of Costa Mesa has heretofore adopted Ordinance 70-25
relating to certain water pollution control regulations affecting industrial
waste, which said ordinance does not contemplate controls in the same area as
that under jurisdiction of the California Regional Water Quality Control Board;
and
WHEREAS, cooperation between local governmental entities and the California
Regional Water Quality Control Board on matters involving the discharge of
waste will benefit the State water quality control program, assist local agencies
in planning for adequate sewage disposal facilities and assure that sufficient
information is available to prevent a threat to the quality of the waters of
this region; and
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Costa
Mesa hereby pledges cooperation to the California Regional Water Quality Control
Board and by the adoption of this resolution hereby directs that notification
be given to the Board of the filing of the following:
1. All tentative subdivision maps.
2. All building permits for dwellings involving six -family
units or more which may result in a waste discharge
other than into an existing community sewer system.
3. All building permits for structures involving waste
discharges in excess of 2,500 gallons per day other than
those into an existing community sewer system.
BE IT FURTHER RESOLVED, that notification be given to the California
Regional Water Quality Control Board of any action pursuant to Section 11551.6
of the Business and Professions Code; and
BE IT
FURTHER
RESOLVED, that the
affected departments
of the City of
Costa Mesa
develop
such forms and such
reporting systems as
they find necessary
to comply
with the
policy established
by this resolution;
and
BE IT FURTHER RESOLVED, that all notification be made in writing and
mailed to California Regional Water Quality Control Board, Santa Ana Region,
6848 Magnolia Avenue, Riverside, California 92506; and

BE IT FURTHER RESOLVED, that a copy of this resolution be forwarded to
the California Regional Water Quality Control Board, Santa Ana Region, and
copies also forwarded to City of Costa Mesa Department of Public Works,
Building Safety and Planning.
