HomeMy WebLinkAbout71-17 - Intention to Annex Sunflower No. 4 and Setting HearingRESOLUTION NO. 71-17 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING ITS INTENTION TO ANNEX CERTAIN TER- RITORY TO THE CORPORATE LIMITS OF SAID CITY, DECLARING REASONS FOR DESIRING SAID ANNEXATION, AND SETTING TIME AND PLACE OF PUBLIC HEARING WHERE PROTESTS MAY BE HEARD. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS ■ FOLLOWS: THAT, Section 35310 Government Code, State of California, provides that the legislative body of the City may initiate proceedings to annex territory; and WHEREAS, it is the desire of the City Council of this City to initiate proceedings for the annexation of property known as Sunflower Annexation No. 4, more particularly described in a legal description attached to this resolution, marked Exhibit "A" and by this specific reference, made a part hereof, and further described by a map attached to this resolution, marked Exhibit "B"; and WHEREAS, the aforementioned section provides that Councilmen set forth the reasons for desiring said annexation and must set a time and place for public hearing, at which time protests may be heard and considered. NOW, THEREFORE, be it resolved that the City of Costa Mesa does hereby declare its intention to annex property known as Sunflower Annexation No. 4 as more particularly described in Exhibit "A" attached hereto. BE IT FURTHER RESOLVED that the reasons for desiring said annexation are as follows: (1) The property to be annexed consists of, in its entirety, the southerly one-half of Sunflower Avenue and a portion of the westerly one- half of Main Street, and the whole of said property consists of public street or unimproved public right of way; (2) It is necessary that this property be annexed to the City of Costa Mesa in order that its maintenance, repair, and upkeep can be insured and in order that its improvement by widening, when necessary, can be undertaken; (3) Annexation of this property is necessary to control access from abutting landowners considering present development and future proposed development, all in order to effectively and safely control vehicle and pedestrian traffic upon said right of way; (4) That the northerly one-half of Sunflower Avenue and the easterly one-half of Main Street are being annexed by the City of Santa Ana, and the maintenance, repair, care, and upkeep of the whole of said street cannot practically be left with the County of Orange and is, in fact, the responsibility of the adjoining cities of Santa Ana and Costa Mesa. BE IT FURTHER RESOLVED that a public hearing shall be held not more than thirty (30) days from the introduction and passage of this resolution, and that iumediately after its passage and sooner than at least four (4) days preceding the date of said hearing, a copy of this resolution shall be published in a newspaper of general circulation published within the City and that a copy of this resolution be posted not less than seven (7) days before the hearing in at least three (3)conspicuous places within the territory to be annexed; and 11 BE IT FURTHER RESOLVED that the date of the hearing for this annexation shall be set for the 19th day of April, 1971, at the hour of 7:30 p.m., in the Council Chambers at the City Administration Building, 77 Fair Drive, Costa Mesa, California, at which time the City Council may alter or amend boundaries of the territory proposed to be annexed, and at which time the Council shall hear protests, if any, against the aforementioned annexation. Thence S. 0° 09' 24" W., 178.18 feet along said city boundary line per Ordinance No. NS -450, being said parallel line, to an angle point therein and a line parallel with and 20.00 feet northerly from the center line of Sunflower Avenue (formerly Huntzinger Avenue); 11. Thence leaving the existing boundary of the City of Santa Ana and following along said existing boundary of the City of Costa Mesa the following courses and distances: N. 89° 11' 09" E., 2348.64 feet to an angle point therein and a line parallel with and 30.00 feet Easterly from the center line of Fairview Road, 60.00 feet in width; 14. Thence N. 0° 09' 24" E., 188.16 feet along said parallel line to a line parallel with and 30.00 feet Southerly from the center line of Sunflower Avenue, 60.00 feet in width; 15. Thence N. 890 26' 11" E., 1122.64 feet along said parallel line to a point in the southerly prolongation of the east right of way line of Greenville Street, 60.00 feet in width; 16. Thence N. 0° 34' 21" W., 5.00 feet along said prolongation to a point on a line parallel with and 25.00 feet southerly from the center line of Sunflower Avenue (formerly Wakeham Avenue), 50.00 feet in width; 17. Thence N. 89° 22' 06" E., 3549.36 feet along said parallel line to a line parallel with and 25.00 feet Westerly from the center line of Bear Street, 50.00 feet in width; 18. Thence S. 0° 22' 08" E., 784.18 feet along said parallel line to an angle point in last mentioned city boundary line as created by said Ordinance No. 272 and by Ordinance No. 276 of said city; 19. Thence N. 89° 44' 08" E., 50.00 feet along said city boundary line per Ordinance No. 276 to an angle point in said city boundary line as created by said Ordinance No. 276 and by Resolution No. 66-1342 of said city; 20. Thence N. 0° 22' 08" W., 37.00 feet along said city boundary line per Resolution No. 66-1342 to the point of beginning. This description and map of proposed annexation does meet the approval of the Surveyor's Office.
