HomeMy WebLinkAbout71-19 - Requesting that Flood Insurance be made available to CitizensRESOLUTION NO. 71-19 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, REQUESTING THE UNITED STATES GOVERNMENT TO MAKE AVAILABLE TO THE CITIZENS OF THE CITY OF COSTA MESA FLOOD INSURANCE UNDER THE NATIONAL FLOOD INSURANCE ACT, PUBLIC LAW 90-448, AND THE MUDSLIDE AMENDMENT TO SAID ACT, PUBLIC LAW 91-152. AND FINDING A NEED THEREFOR. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: THAT, WHEREAS, portions of the City of Costa Mesa are subject to recurrent flooding and landslides, resulting in damage to property and potential loss of life, and WHEREAS, the National Flood Insurance Act, Public Law 90-448, and the Mudslide Amendment, Public Law 91-152, are maintained to make avail- able to the public insurance to serve and fill this public need, and WHEREAS, Sections 1910.2 and 1910.3 of the National Flood Insurance Program Regulations require expression of interest and assurances. NOW, THEREFORE, the City Council of the City of Costa Mesa does hereby find, determine, order, declare and resolve as follows: The City of Costa Mesa: 1. Expresses hereby its desire and need for participation in and receiving the benefits of the National Flood Insurance Program. e 2. Recognizes and plans to evaluate flood hazards in all its official iL actions relating to land use in flood plain areas having special hazards. 3. Hereby proposes to enact by December 31, 1971, and maintain and enforce within areas having special flood hazards, adequate land use and control measures with effective provisions consistent with the criteria set forth in subpart B of Section 1910 of the National Flood Insurance Program regulations. 4. If necessary, will seek state enabling legislation conferring authority to enact land use and control measures designed to reduce exposure of property to flood losses. 5. Will assist the National Flood Insurance Program administrator, at his request, in delineating the limits of the flood plain having special flood hazard on local maps of sufficient scale to identify the location of building sites. 6. After flood insurance is made available, will furnish representatives of appropriate federal or state agencies or of the National Flood Insurers Association, information as requested concerning new or substantially improved structures within the area of special flood hazard. 7. Will cooperate with federal, state and local agencies undertaking to study, survey, map and identify flood prone areas, and will cooperate with neighboring jurisdictions with respect to adjoining flood plains in order to prevent aggravation of the flooding problem. 8. Will appoint or designate an agency or official with the responsibility, authority and means to implement the commitment made in this resolution. BE IT FURTHER RESOLVED that copies of this resolution be forwarded to the Secretary of Housing and Urban Development and to the U. S. Army Engineers District, Los Angeles, urging acceleration of the flood plain information report programs as required for compliance with the federal regulations for administration of the National Flood Insurance Program. BE IT FINALLY RESOLVED that certified copies of this resolution be forwarded to the representatives of Orange County at the nations Capital in Washington, D.C.
