RESOLUTION NO. 71-49
A RESOLUTION OF THE CITY COUNCIL OF TEE CITY OF COSTA MESA,
CALIFORNIA, COVERING PRELIMINARY DETERMINATION OF THE
LEGISLATIVE BODY UNDER "SPECIAL ASSESSMENT INVESTIGATION,
LIMITATION AND MAJORITY PROTEST ACT OF 1931," DETERMINING
THE GENERAL NATURE, LOCATION AND EXTENT OF THE PROPOSED
WORK, AND ORDERING THE PREPARATION OF A REPORT OF SAID
IMPROVEMENT, IN THE MATTER OF THE IMPROVEMENT OF, AN ALLEY
BETWEEN TUSTIN AVENUE AND RAYMOND AVENUE BETWEEN MAGNOLIA
STREET AND BROADWAY IN SAID CITY, ASSESSMENT DISTRICT
NUMBER 20.
The City Council of the City of Costa Mesa, California does hereby
resolve as follows:
SECTION 1. That certain improvements of property for public use are
proposed to be done, made within the boundaries of the proposed assessment
district, hereinafter described, within the boundaries of said City. In
connection therewith, said City Council hereby finds and determines as follows:
A. That the nature of the proposed improvement is as follows: the
clearing and grubbing, removal of obstructions, excavation, construction of
asphalt concrete pavement and concrete gutter, adjusting sewer manholes,
relocating wood fence, removing and replacing concrete driveways, together
with appurtenances and appurtenant work on the alley as heretofore described
in said City, all as shown on that certain plan heretofore approved by
this Council and on file in the office of the City Clerk and open to public
inspection; that said plan is hereby referred to for a description of
the proposed, and work and shall govern for all particulars relative to said
improvement.
B. That the boundaries of the district of lands proposed to be assessed
to pay the costs and expenses of said proposed work and improvement are as
shown upon the said plan, which plan has been heretofore approved by this
Council; said plan is on file in the office of the City Clerk and open to
public inspection; and said plan shall govern for all details as to the
extent of said assessment district.
C. That the legislative body further determines that no contribution
and funds is necessary or essential toward the work of improvement and
that all costs of said work are to be assessed upon the district.
D. The statute under which it is proposed to conduct proceedings is
the "Improvement Act of 1911," being Division 7 of the Streets and Highways
Code of the State of California, with improvement bonds to be issued as
authorized under the provisions of said Act; that the redemption provisions
of said bonds require the payment of a premium of seven percent (77) of
the unpaid principal.
SECTION 2. That Norman K. Spellman, Registered Civil Engineer #14526,
a comptetent person heretofore employed by this Council for the purpose of
preparing a report, is hereby required to procure all necessary information
to prepare a report of the proposed improvement in the manner and form provided
in Division 4 of said Streets and Highways Code, that said report shall, as
a part thereof, contain a copy of this resolution.
