A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA
MESA, CALIFORNIA, CENSURING THE ACTIONS OF SUPERVISORS
CASTERS AND BATTIN OF THE ORANGE COUNTY BOARD OF SUPER-
VISORS; CALLING FOR THEIR REMOVAL AS MEMBERS OF THE
LOCAL AGENCY FORMATION COMMISSION AND SETTING FORTH
THE REASONS THEREFOR.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS:
THAT WHEREAS, Supervisor Caspers was duly elected as a Supervisor of
the 5th Supervisorial District at the last Supervisorial election for that
position; and
WHEREAS, said Caspers was subsequently appointed to serve as a member
of the Local Agency Formation Commission; and
WHEREAS, said Caspers has recently participated in a series of power
maneuvers attempting to rig the membership of the Local Agency Formation
Commission; and
WHEREAS, these acts have culminated in an unannounced meeting on a
Monday morning, August 9, which said meeting was conducted without proper
notice to all of the members of the Local Agency Formation Commission,
without roll call, Pledge of Allegiance, approval of the minutes of any
prior meeting, without full staff present, in apparent violation of the
Brown Act and without regard for the interests of the citizens of Orange
County; and
WHEREAS, at said meeting Caspers, Battin and Hyde, a non-member,
S claiming a quorum attempted to remove Charles Pearson, a member, and appoint
[L Herb Licker in his place; and
WHEREAS, it also appears that said Supervisor Caspers has been unable
to resist the partisan political coercion of Chairman Battin in Battings
vendetta against the Irvine Company, and those citizens desiring to incor-
porate the City of Irvine; and
WHEREAS, said Supervisor Caspers has lost his effectiveness as a useful
impartial member of the Local Agency Formation Commission by reason of his
actions and the proceedings as set forth in this Resolution; and
WHEREAS, the judgment of Supervisor Caspers as a member of the Local
Agency Formation Commission has been tainted and diminished by his partici-
pation as set forth in this Resolution;
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
THAT, the City Council of the City of Costa Mesa hereby finds and declares
that although elected from the 5th Supervisorial District, Supervisor Caspers
does not represent the view of the City of Costa Mesa which lies within said
District, in any of his actions concerning the membership of the Local Agency
Formation Commission; and
BE IT FURTHER RESOLVED, that the Board of Supervisors of Orange County
be requested to, by official action at a regular meeting, censure Supervisors
Caspers and Battin for their actions in connection with the attempted rigging
of the membership of the Local Agency Formation Commission; and
BE IT FURTHER RESOLVED, that both Caspers and Battin be requested to
resign their positions as members of the Local Agency Formation Commission
and in the event they refuse to resign, that they be removed by the official
action of the Board of Supervisors; and

BE IT FINALLY RESOLVED, that a copy of this Resolution be forwarded to
each Mayor of each City in Orange County, to each member of the Board of
Supervisors, to each member of the Local Agency Formation Commission and to
the Orange County Division of the League of California Cities.
PASSED AND ADOPTED this 16th day of August, 1971.

thereof held on the 16th day of August, 1971.
