HomeMy WebLinkAbout71-62 - Requesting Bicycle Legislation�Z9E RESOLUTION NO. 71-62 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF COSTA MESA REQUESTING THAT THE LEGISLATION BE ENACTED TO ENABLE LOCAL AGENCIES TO REACT TO THEIR INDIVIDUAL SITUATIONS REGARDING BICYCLE VERSUS VEHICLE TRAFFIC WITHOUT BEING IN CONFLICT WITH THE CALIFORNIA VEHICLE CODE. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, volumes on city streets are increasing to a level where they are becoming dangerous to bicycle flow; and WHEREAS, bicycle popularity is increasing; and WHEREAS, Section 21100 through and including 21116 of the California Vehicle Code allows local regulation of vehicular traffic for specific instances; and WHEREAS, Section 21200 authorizes the operation of bicycles on public streets and highways and makes them subject to the Vehicle Code insofar as the rules of the road are concerned (Section 20000 at seq.); and WHEREAS, this would make bicycles subject to Section 22500 California Vehicle Code (f) and prohibits stopping, parking or leaving vehicles on public sidewalks; and WHEREAS, this would also make bicycles subject to Section 21663, California Vehicle Code, which prohibits the operation on public sidewalks; and WHEREAS, in certain locations it would be safer for bicycles to ride on the sidewalk, which is presently prohibited in the California Vehicle Code; and WHEREAS, the City of Costa Mesa, as do other local jurisdictions, desires to obtain flexibility in Vehicle Code application so that local agencies could provide for their individual requirements for regulation of bicycle traffic as it might seem fit. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa Mesa does hereby request that the Section 21100 through and including Section 21116 of the California Vehicle Code be amended to allow for the inclusion of local regulation of bicycle traffic.
