RESOLUTION NO. 71-74
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, ORDERING THE WORK DESCRIBED
IN RESOLUTION OF INTENTION NO. 71-65, ADOPTED ON
THE 7TH DAY OF SEPTEMBER, 1971 IN THE MATTER OF
THE CONSTRUCTION OF IMPROVEMENTS IN AN ALLEY
BETWEEN MAGNOLIA STREET AND BROADWAY FROM TUSTIN
AVENUE TO RAYMOND AVENUE. (ASSESSMENT DISTRICT
NO. 20)
THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, pursuant to
the provisions of the "Improvement Act of 1911," being Division 7 of the
Streets and Highways Code of the State of California, does hereby resolve
as follows:
That the public interest and convenience require the work hereinafter
mentioned to be done, and therefore, said City Council hereby orders the
following work to be done and improvements to be made in said City, to wit:
The clearing and grubbing, removal of obstructions, excavation, con-
struction of asphalt concrete pavement, and concrete gutter, adjusting sewer
manholes, relocating wood fence, removing and replacing concrete driveways,
all as more particularly described in Resolution of Intention No. 71-65,
passed and adopted by the City Council of the City of Costa Mesa on the 7th
day of September, 1971, and on file in the Office of the City Clerk of the
City of Costa Mesa.
For further particulars, reference is hereby made to said Resolution of
Intention No. 71-65, and to plans, profiles and drawings for the construction
of said improvements, consisting of two pages, and to the specifications for
the said work heretofore adopted by the said City Council and on file in the
office of the City Clerk of said City, and all of said plans, profiles and
drawings and specifications heretofore approved by the City Council of the
City of Costa Mesa reference is hereby made thereto for a more particular
description of the said work.
Said City Council has determined and declared that the contemplated
work or improvement hereinbefore mentioned was, in the opinion of the City
Council, of more than local or ordinary public benefit and the said City
Council has made the expenses of the said work or improvement chargeable
upon a district. For the particular description of the said assessment
district reference is hereby made to the said Resolution of Intention
No. 71-65.
Said City Council has determined and declared that serial bonds bearing
interest at the rate of seven percent (7%) per annum shall be issued to
represent each assessment of Fifty Dollars ($50.00) or more, remaining
unpaid for thirty (30) days after the date of the recordation of the warrant.
Said serial bonds shall extend over a period ending nine (9) years from the
second day of January next succeeding the next September First following
their date. The redemption provisions of said bonds shall require the
payment of a premium of five percent (5%) of the unpaid principal and the
words "together with a premium of five percent (5%) of said unpaid principal"
shall be added after the redemption clause in the bond form of the bonds
issued.
The Treasurer of the City of Costa Mesa shall retain the first one
percent (1%) penalty as cost of servicing any delinquency and the bonds
shall provide for said one percent (1Y,) in accordance with Section 6442
of the Streets and Highways Code.
All work herein ordered shall be done and carried through in pursuance
of an act of the Legislature of the State of California designated the
"Improvement Act of 1911" being Parts 1, 2, 3, 4, 5 and 6 of Division 7
of said Streets and Highways Code.

The Superintendent of Streets is hereby authorized to make change orders
in work without the necessity of hearing and said change orders shall be in
writing and shall not exceed the limitations as set forth in Section 5236
of the Streets and Highways Code.
The City Clerk of the said City hereby is directed to post conspicuously
for ten (10) days on or near the Chamber door of the said City Council in the
manner and form required by said Code, a notice inviting sealed proposals or
bids for doing the work ordered and the said City Clerk is hereby directed to
publish twice in the Orange Coast Daily Pilot, a daily newspaper, printed,
published and circulated in said City, and hereby designated for that purpose
by the City Council, a notice inviting such proposals or bids for doing the
said work and referring to the specifications of file.
The City Clerk is also directed to open, examine and declare all bids at
a public meeting called by said Clerk, and to report the results of the
bidding, to this Council at the next regular meeting, after the bid opening.

above and foregoing Resolution No. 71-74 was duly and regularly passed and
adopted by the City Council of the City of Costa Mesa at a regular meeting
thereof held on the 18th day of October, 1971.
