HomeMy WebLinkAbout71-81 - Awarding Contract in Assessment District 20RESOLUTION NO. 71-81 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AWARDING A CONTRACT FOR THE WORK DESCRIBED IN RESOLUTION OF INTENTION NO. 71-65. RESOLVED: That the City Council of the City of Costa Mesa, California, did on the 4th day of November, 1971, publicly open, examine and declare all sealed proposals or bids for the following work to be done in said City, to wit: The clearing and grubbing, removal of obstructions, excavation, con- struction of asphalt concrete pavement and concrete gutter, adjusting sewer manholes, relocating wood fence, removing and replacing concrete driveways, together with appurtenances and appurtenant work in connection therewith, in an alley between Magnolia Street and Broadway from Tustin Avenue to Raymond Avenue, all as more particularly described in Resolution of Intention No. 71-65, and in plans, profiles, drawings and diagram for the construction of said improvements, consisting of two (2) sheets, on file in the office of the City Engineer of said City of Costa Mesa, and reference is hereby made to the specifications for the said work heretofore adopted by the said City Council and on file in the office of the City Clerk of said City, and all of said plans, profiles, drawings and specifications heretofore approved by the said City Council of the said City of Costa Mesa are hereby referred to for a more particular description of said work. Said City Council has determined and declared that the contemplated work and improvement heretofore mentioned was, in the opinion of the City Council of more than local or ordinary public benefit and that said City Council has made the expense of said work and improvement chargeable upon the District. For the particular description of the said Assessment District reference is hereby made to said Resolution of Intention No. 71-65. Said City Council has determined and declared that serial bonds bearing interest at the rate of seven (7) percent per annum and extending over a period ending nine (9) years from the second day of January next succeeding the next September first following their date, will be issued hereunder in the manner provided by the "Improvement Act of 1911," Division 7 of the Streets and Highways Code of the State of California, to represent each assessment of Fifty ($50.00) Dollars or more remaining unpaid for thirty (30) days after the date of the recordation of the warrant. The redemption provisions of said bonds shall require the payment of a premium of five percent (5%) of the unpaid principal, and the words "together with a premium of five percent (5%) of said unpaid principal" shall be added after the redemption clause in the bond form of the bonds issued. The Treasurer of the City of Costa Mesa shall retain the first one percent (1%) penalty as cost of servicing any delinquency and the bonds shall provide for said one percent (1%) in accordance with Section 6442 of the Streets and Highways Code. All of the work herein ordered shall be done and carried through in pursuance of an Act of the Legislature of the State of California, designated the "Improvement Act of 1911, being Division 7 of the Streets and Highways Code of the State of California. Said City Council hereby rejects all of the said proposals and bids excepting the next hereinafter mentioned, and hereby awards the contract for _ said work and improvement to the lowest responsible bidder, to wit: Hardy and Harper, Inc., at the prices named in said bid for said work on file in the Office of the City Clerk of said City. The City Clerk of said City is hereby directed to cause a Notice of Award of Contract to be published in the manner and form required by said Code, by two insertions in the Orange Coast Daily pilot, a daily newspaper X32 published and circulated in the said City of Costa Mesa, and hereby designated for the purpose of the said City Council, and said City Clerk shall record the Notice of Award of Contract in the Office of the County Recorder for Orange County, State of California, in the manner and form provided for in Section 5248 of the Streets and Highways Code of the State of California.
