A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF COSTA MESA, CALIFORNIA, APPOINTING A TIME
AND PLACE FOR HEARING PROTESTS IN RELATION
TO THE PROPOSED IMPROVEMENT REFERRED TO IN
RESOLUTION OF INTENTION NO. 72-2 AND DIRECT-
ING THE CLERK OF SAID CITY COUNCIL TO GIVE
NOTICE OF SAID HEARING.
WHEREAS, the City Council of the City of Costa Mesa, California, did,
in a Resolution of said City Council adopted December 20, 1971, pursuant to
the provisions of the "Street Lighting Act of 1919" of the State of
California (Part 1 of Division 14 of the Streets and Highways Code of the
State of California) as amended, and particularly as contemplated under the
provisions of Sec. 18041 of said law and under the alternative procedure for
levying and collecting assessments on ad valorem basis, provided for in
Chapter 8.5 of said "Street Lighting Act of 1919," require the City Engineer
of said City to make and file with the Clerk of said City Council a report
in writing presenting certain matters relating to a proposed lighting
maintenance and service district in said City; and
WHEREAS, the City Engineer, pursuant to the requirements of said City
Council expressed in said Resolution of December 20, 1971, on file in the
Office of the City Clerk (who is ex -officio Clerk of the City Council) of
said City his report in writing responsive to the requirements of the said
Resolution of December 20, 1971, and of said law relating to the proposed
lighting maintenance and service district in said City; and
WHEREAS, the said City Council has proceeded to carefully examine,
inspect and consider the said Report, and has afforded all persons interested
an opportunity to be heard with reference thereto, and is satisfied with each
and all of the various items thereof and the matters therein set forth; and
WHEREAS, said City Council did in Resolution No. 72-1 approve said
report on the 3rd day of January, 1972, in conformity with the provisions of
said "Street Lighting Act of 1919," and
WHEREAS, after the approval of said report, and in conformity with the
provisions of said "Street Lighting Act of 1919," said City Council did duly
and regularly adopt its Resolution of Intention No. 72-2, entitled:
"A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA
MESA, CALIFORNIA, DECLARING ITS INTENTION TO ORDER CERTAIN
LIGHTING FIXTURES AND APPLIANCES ON CERTAIN STREETS AND
PUBLIC PLACES IN THE CITY OF COSTA MESA, TO BE MAINTAINED
AND ELECTRIC CURRENT TO BE FURNISHED FOR LIGHTING SAID
FIXTURES FOR A PERIOD OF MONTHS, ENDING JUNE 30TH, 1977."
and;
WHEREAS, the proposed improvement of the street lighting system shall
be for a period of five (5) years beginning July 1, 1972, and ending June 30,
1977; and
WHEREAS, it now becomes the duty of said Council to appoint a time and
place for hearing protests in relation to the proposed improvement referred
to in said Resolution of Intention No. 72-2, and to direct the giving of
notice of said hearing;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA,
DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That the 7th day of February, 1972, at the hour of 6:30
o'clock p.m., in the Council Chamber of the City Council, in the Costa Mesa
City Hall, located at 77 Fair Drive, Costa Mesa, California, be and the same
is hereby appointed as the time and the Council Chamber of the Costa Mesa
City Hall of the City of Costa Mesa, California, is hereby appointed as the
place for hearing protests in reference to the said proposed improvement.
Section 2. That the City Clerk (who is ex -officio Clerk of the City
Council) is hereby authorized, designated and directed to give notice of said
hearing in time, form and manner as required by law.
Section 3. That the Orange Coast Daily Pilot, a daily newspaper of
general circulation, published in the City of Costa Mesa, California, and
circulated generally within said City of Costa Mesa, California, is hereby
designated as the newspaper in which such notice shall be published.
Section 4. That the City Clerk shall certify to the passage and
adoption of this Resolution; shall
enter the same
along with the original
Resolutions of the City Council of
said City;
and
shall make a minute of the
records of the proceedings of the
City Council
of
said City in the minutes
of the meeting at which the same is
passed and
adopted.
PASSED, APPROVED AND ADOPTED

on the 3rd day of January 1972, the foregoing Resolution, being Resolution
No. 72-3, was considered section by section and that said Resolution was
then passed and adopted as a whole by the following roll call vote, to wit:
