HomeMy WebLinkAbout72-15 - Opposing Service of Arrest Warrants by Marshal's Office�rc RESOLUTION N0. 72-15 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, OPPOSING THE SERVICE OF ARREST AND BENCH WARRANTS BY THE ORANGE COUNTY MARSHAL'S OFFICE. WHEREAS, the City Council of the City of Costa Mesa has become aware of the infringement of the Orange County Marshal's Office into the area of law enforcement by the service of warrants; and WHEREAS, the service of arrest warrants affords the arresting agency the opportunity to become familiar with those who are prone to commit criminal offenses and offend the process of the courts and the criminal justice system; and WHEREAS, the service of arrest warrants by police agencies affords the opportunity to lawfully arrest those accused of crimes having been committed within their respective jurisdictions, allowing for the lawful seizure of evidence; and WHEREAS, duly constituted police agencies are currently capable of the service of arrest warrants without the gross addition of personnel; and WHEREAS, the duplication of public service costs and efforts should be minimally maintained; and WHEREAS, the Orange County Marshal's Office is ill-equipped to properly handle the efficient service of arrest warrants without additional personnel and sophisticated communications systems; and WHEREAS, that through the service of arrest and bench warrants municipalities realize a significant source of revenue, and deprivation of these monies would seriously affect municipal goverment operations. y BE IT THEREFORE RESOLVED by the City Council of the City of Costa Mesa that the City Council opposes any attempt by any agency of this County to assume the responsibility for the service of arrest warrants within the jurisdictional areas of the several cities, and takes the position that arrest warrants should be directed to the respective police agencies and that bench warrants should be directed to the police agency having jurisdiction of the area of the arrestee's residence, or known place of presence.
