RESOLUTION NO. 72-20 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, CONFIRMING THE REPORT OF THE CITY ENGINEER DATED DECEMBER 20, 1971, PREPARED PURSUANT TO THE PROVISIONS OF THE "STREET LIGHTING ACT OF 1919", AND REFERRED TO IN RESOLUTION OF INTENTION NO. 72-2, AND ORDERING THE WORK AND LEVYING THE ASSESSMENT FOR SERVICE NECESSARY TO MAINTAIN AND ILLUMINATE BY ELECTRIC ENERGY THE STREET LIGHTS WITHIN SAID CITY. WHEREAS, the City Council of the City of Costa Mesa, California, did, on the 20th day of December, 1971, adopt Resolution No. 71-90 ordering the City Engineer to make and file a report in writing pursuant to the provisions of the "Street Lighting Act of 1919", being Part 1, Division 14 of the Streets and Highways Code of the State of California; and WHEREAS, the City Engineer did, on the 3rd day of January, 1972, file said report with said City Council; and WHEREAS, said City Council approved said report by Resolution No. 72-1 adopted on the 3rd day of January, 1972; and WHEREAS, on said date said City Council did further adopt Resolution No. 72-2 declaring its intention and ordering the proposed street lighting improvements; and WHEREAS, said City Council did on said date adopt Resolution No. 72-3 appointing the time and place for hearing protests to the proposed improvement; and WHEREAS, at the time and place stated above for hearing protests, said City Council did proceed to hold and did hold said hearing; and WHEREAS, at the time and place above stated for hearing protests in reference to the proposed improvement and assessment, no protests, either written or oral, were submitted or made; and WHEREAS, the said City Council having held said hearing, and being fully advised in the premises, has now acquired jurisdiction to proceed further; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, FIND, DETERMINE AND ORDER AS FOLLOWS: I THAT said Council does hereby approve, confirm and adopt the report of the City Engineer dated December 20, 1971, and does hereby approve and confirm the assessment proposed for the proposed improvement set forth and referred to in said report, which said report is now on file in the Office of the City Clerk of the City of Costa Mesa, open to public inspection, and hereby referred to and made a part hereof. II THAT the boundaries of the district as shown in said report are hereby established and the description of said boundaries are set forth in a map on file with the Assessor for Orange County as of December 31, 1971, that no zones within said district are established. III THAT the period of time for which the proposed improvement shall continue is five (5) years beginning July 1, 1972, and ending June 30, 1977. V THAT the estimated cost of the proposed improvement for the first year is $591,589.97; that all of the estimated cost for the first year shall be borne by the district. VI THAT the City Council does hereby order the proposed improvement to be made, and said Council does hereby order that the estimated cost of the proposed improvement shall be paid by special assessment taxes levied upon all the lands and improvements within the district. VII THAT the City Clerk of said City is hereby ordered to transmit to the County Assessor for the County of Orange, and to the State Board of Equalization, a certified copy of this resolution together with a map or plan of the district and a legal description of the boundaries of said district. VIIl THAT the City Clerk shall certify to the passage and adoption of this resolution and shall cause the same to be entered among the original resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of the meeting at which the same was passed and adopted. IX THAT this resolution shall take effect immediately. PASSED AND ADOPTED this 7th day of February, 1972. V THAT the estimated cost of the proposed improvement for the first year is $591,589.97; that all of the estimated cost for the first year shall be borne by the district. VI THAT the City Council does hereby order the proposed improvement to be made, and said Council does hereby order that the estimated cost of the proposed improvement shall be paid by special assessment taxes levied upon all the lands and improvements within the district.
