RESOLUTION NO. 72-26
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, OBJECTING TO ANY MODIFICATION OF THE DISTRIBUTION
OF SALES AND USE TAXES THROUGHOUT THE STATE, WHICH WOULD BASE
SAID DISTRIBUTION UPON THE POPULATION FACTOR OR OTHER MEANS,
AND DECLARING THEIR REASONS THEREFOR.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS
FOLLOWS:
THAT, WHEREAS, the City of Costa Mesa pursuant to the authorizations
set forth in the California Constitution, and Section 37101 California
Government Code, did on or about November 21, 1961 by Ordinance No. 412
establish a city sales tax; and
WHEREAS, pursuant to the Bradley -Bums Uniform Local Sales and Use
Tax Law, the City and the State of California through the State Board of
Equalization have contracted for the purpose of authorizing the State of
California to act as the collection agency for the City of Costa Mesa,
for the aforementioned sales tax; and
WHEREAS, the City of Costa Mesa has embarked upon long range fiscal
planning, relying upon the sales tax as a part of a balanced fiscal policy
to provide the revenue for necessary municipal services; and
WHEREAS, the City of Costa Mesa has undertaken extended capital
improvements throughout the City with local taxpayers dollars to encourage
private enterprise to produce sales tax generating developments; and
WHEREAS, the full burden of the maintenance, repair, upkeep and
replacement of these capital improvements falls upon the taxpayers of the 1
City of Costa Mesa, irrespective of the source of said depreciation; and J
WHEREAS, the cost of increased needs for public safety services such
as police and fire, necessitated because of the encouragement for private
enterprise to produce sales tax generating developments falls upon the tax-
payers of the City of Costa Mesa; and
WHEREAS, responsible fiscal planning for the City of Costa Mesa
designed to create a fair balance for the responsibility of tax revenue,
between the real property tax and other tax sources, including the sales
tax requires that the present method of sales tax distribution be maintained;
and
WHEREAS, levels of income and material needs which regulate family
spending are so varied in nature that it is impossible to fairly allocate
sales tax income on a population basis; and
WHEREAS, any revision of the distribution of sales tax on a population
basis, or on any basis other than the present formula, constitutes an un-
reasonable and unfair penalty upon enlightened fiscal planning, established
and relied upon over a period of years by the City of Costa Mesa.
NOW, THEREFORE, BE IT RESOLVED, that the City of Costa Mesa is unalter-
ably opposed to any modification of the imposition and collection of sales
tax from the system that now exists.
BE IT FURTHER RESOLVED, that the City of Costa Mesa is unalterably
opposed to any infringement upon its right of local control in the
imposition and collection of sales taxes, as authorized by the laws of the
State of California.

BE IT FURTHER RESOLVED, that the legislators representing this City
be urged to actively work toward the defeat of any Legislation introduced
for the purpose of allocating sales tax revenues on a population basis.
BE IT FURTHER RESOLVED, that the League of California Cities be
requested to actively oppose any Legislation introduced to modify the distri-
bution of sales tax on a population basis.
BE IT FINALLY RESOLVED, that other cities throughout the State of
California be encouraged to adopt similar Resolutions.
