HomeMy WebLinkAbout72-57 - Directing City Attorney to Proceed with CondemnationRESOLUTION NO. 72-57 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, FINDING, DETERMINING AND DECLARING THAT THE PUBLIC INTERESTS AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN STREET EASEMENTS AND RIGHTS OF WAY FOR PUBLIC STREET PURPOSES, AND AUTHORIZING ACQUISITION OF SAID EASEMENTS AND RIGHTS OF WAY BY CONDEMNATION, AND DIRECTING THE CITY ATTORNEY TO PROCEED WITH SUCH ACTION. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: THAT WHEREAS, the City of Costa Mesa is about to grade, pave, construct curbs and gutters, concrete cross gutters, and to make such other improve- ments as are generally found in connection with municipal street improvements; and WHEREAS, detailed plans and specifications for said work are being designed and compiled by the City Engineer of the City of Costa Mesa, a copy of which will be kept in the Office of the City Clerk; and WHEREAS, it is in the public interest and necessity to acquire the said easements and rights of way for public street purposes. NOW, THEREFORE, the City Council of the City of Costa Mesa does hereby find, determine, order, declare and resolve as follows: SECTION 1. That the public interest and necessity require the acquisition, construction and completion by the City of Costa Mesa, of a public improvement, to wit, the grading, paving, construction of curbs and gutters, concrete cross gutters, and such other improvements as are generally found in municipal street improvements, including such demolition and removal of obstructions as may be necessary, all together with appurtenances and appurtenant work in connection therewith, in Fairview Road. SECTION 2. That the public interest and necessity require the acquisition for and in connection with said public improvement of the street easements and rights of way for public street in real property, and as hereinafter in this resolution more particularly described. SECTION 3. That said proposed public improvement is planned and located in a manner which will be most compatible with the greatest public good and the least private injury. SECTION 4. That said City proceed, and it is hereby authorized, directed, and empowered, and ROY E. JUNE, the City Attorney for said City, is hereby authorized, directed and empowered as follows: a) To acquire in the name of the City of Costa Mesa the real property, interest in real property, and the easements and rights of way in real property hereinafter expressly described, in and to the said hereinafter described real property, or interests in real property, by condemnation, in accordance with the provisions of the Streets and highways Code, the Government Code, the Code of Civil Procedure, and the Constitution of the State of California relating to Eminent Domain. b) To prepare and prosecute, in the name of the City of Costa Mesa, such proceeding or proceedings in the proper Court having jurisdiction thereof, as is necessary for such acquisition. c) To make application to said Court for an Order fixing the amount of such security in the way of money deposit, as said Court may direct, and for an Order permitting said City to take immediate possession and use of said real property, interests, easements and rights of way in real property, as rights of way for public street purposes. d) To make deposit of such security out of proper funds of said City, in such amount so fixed and determined, and in such manner as said Court in which said condemnation proceedings are pending may direct. SECTION 5. The real property, or interests in real property or existing improvements, which the City Attorney of the City of Costa Mesa is authorized and directed to acquire in the name of the City, is hereinafter described: A. As to all of the following described real property, or interest in real property or existing improvements, the interest to be acquired as to each parcel shall be a perpetual easement and right of way for street purposes. Said real property, or interests in real property, or existing improve- ments, to be so acquired by condemnation as the easements and rights of way for public street purposes, and each parcel thereof, are situated in the City of Costa Mesa, County of Orange, State of California, and are more particularly described as follows: PARCEL 1-A: That portion of Lot A of the Banning Tract, in the Rancho Santiago de Santa Ana, as partitioned March 1890, Case No. 6385 in the Superior Court of Los Angeles County, California, described as follows: Beginning at the Southwest corner of Tract No. 5617, as shown on a map thereof recorded in Book 202, pages 35 and 36 of Miscellaneous Maps, in the Office of the County Recorder of said County of Orange; thence along the Westerly pro- longation of the Southerly line of said Tract No. 5617, West a distance of 357.35 feet to the center line of Fairview Road as shown on said Tract No. 5617; thence along said center line North 00 09' 00" East 363.14 feet to a line parallel with and distant Southerly 210.00 feet measured at right angles from the center line of Fair Drive as shown on said last mentioned tract; thence East along said parallel line a distance of 210.00 feet; thence parallel with the center line of Fairview Road, South 0° 09' 00" West 30.14 feet to the Westerly prolongation of the Northerly line of said Tract No. 5617; thence East along said prolongation 147.35 feet to the Northwesterly corner of said Tract No. 5617; thence along the Westerly line of said Tract, South a distance of 333.00 feet to the point of beginning. The portion to be condemned is described as: Beginning at a point in the Easterly line of Fairview Road, said point being 210.00 feet Southerly from the center line of Fair Drive and 50.00 feet Easterly from the center line of Fairview Road; thence Easterly along a line parallel with Fair Drive a distance of 22.00 feet; thence Southwesterly along a line to a point which is 62.00 feet Easterly from the center line of Fairview Road and 260.00 feet from the center line of Fair Drive; thence Southwesterly along a line to a point which is 573.16 feet Southerly from the center line of Fair Drive and 50.00 feet Easterly from the center line of Fairview Road; thence Northerly parallel with the center line of Fairview Road to the point of beginning. PARCEL 2-A: That certain approximately square shaped tract of land located at the South- east corner at the intersection of Fairview Road and Fair Drive having 160.00 feet and 160.00 feet net frontage being the North 210.00 feet of the West 210.00 feet of that portion of Lot "A" of the Banning Tract, in the Rancho Santiago de Santa Ana, as shown on a map attached to the report of the referees filed April 14, 1890 in Case No. 6385 in the Superior Court of the State of California, in and for the County of Los Angeles, California, described as follows: Beginning at the intersection of the center line of Fairview Road with the center line of Fair Drive; thence South 210.00 feet along said center line of Fairview Road; thence North 89° 50' 00" East 210.00 feet parallel with said center line of Fair Drive; thence North 210.00 feet parallel with said center line of Fairview Road to said center line of Fair Drive; thence South 89° 50' 00" West 210.00 feet to the point of beginning. The portion to be condemned is described as: Beginning at a point in the Southerly line of Fair Drive, said point being 50.00 feet Southerly from the center line of Fair Drive and 210.00 feet Easterly from the center line of Fairview Road; thence Southerly along a line which is parallel with the center line of Fairview Road to a distance of 10.00 feet; thence Southerly along a line parallel with the center line of Fair Drive to a point in a curved line, said point being 105.00 feet Easterly from the center line of Fairview Road; thence along said curved line which is concaved South- easterly to a point which is 78.00 feet Easterly from the center line of Fairview Road; thence Southwesterly to a point which is 72.00 feet Easterly from the center line of Fairview Road and 210.00 feet Southerly from the center line of Fair Drive; thence Westerly parallel with the center line of Fair Drive a distance of 22.00 feet; thence Northerly along the Easterly line of Fairview Road a distance of 160.00 feet; thence Easterly along the Southerly line of Fair Drive to the point of beginning. PARCEL 3-A: That portion of Lot A of the Banning Tract in the Rancho Santiago de Santa Ana, as shown on a Map filed in the Case of Hancock Banning versus Mary H. Banning for partition in Case No. 6385 upon the Register of Actions of the Superior Court of the State of California, in and for the County of Los Angeles, described as follows: Beginning at the intersection of the center line of the Old Santa Ana Road with the North line of Lot "A" of said Banning Tract; thence South 89° 56' 13" East 876.98 feet along the North line of said Lot "A"; thence South 1775.86 feet to the Northerly line of the 100 -foot strip of land described in deed of Right of Way for "Fair Drive" to Orange County, recorded August 2, 1950 in Book 2050, page 59 of Official Records; thence North 89° 56' 13" West 881.63 feet to the center line of said Old Santa Ana Road; thence North 1775.86 feet to the point of beginning. Except therefrom that portion thereof included within the lines of Fairview Road, 100.00 feet wide, as described in Deed to the County of Orange, recorded October 18, 1949 in Book 1917, page 86 of said Official Records. Also excepting therefrom that portion thereof included within the lines of Arlington Drive, as described in Deed to the City of Costa Mesa, recorded February 17, 1969 in Book 8876, page 156 of said Official Records. The portion to be condemned is described as: A. All that land lying Northwesterly of a curved line having a radius of 27.00 feet concave Southeasterly and tangent to a line lying 40.00 feet Southerly of and parallel to the center line of Arlington Drive and tangent to a line lying 80.00 feet Easterly of and parallel to the center line of Fairview Road. B. Beginning at a point in the Easterly line of Fairview Road, said point being 50.00 feet Easterly from the center line of Fairview Road and 97.00 feet Northerly from the center line of Fair Drive; thence Easterly along a line parallel with the center line of Fair Drive a distance of 25.00 feet; thence Northerly to a point which is 70.00 feet from the center line of Fairview Road and on the Easterly prolongation of the center line of Princeton Drive; thence Northerly along a line parallel with the center line of Fairview Road to a point which is 202.00 feet Southerly from the center line of Arlington Drive; thence Northeasterly to a point which is 152.00 feet Southerly from the center line of Arlington Drive and 80.00 feet Easterly from the center line of Fairview Road; thence Northerly along a line parallel with the center line of Fairview Road to a point 67.00 feet Southerly from the center line of Arlington Drive; thence Westerly along a line parallel with the center line of Arlington Drive a distance of 30.00 feet; thence Southerly along a line parallel with the center line of Fairview Road to the point of beginning. PARCEL 4-A: That portion of the Santa Ana Army Air Base being a portion of Lots 8 and 11 of Berry Rancho as shown on a Map recorded in Book 9, page 7 of Miscellaneous Records of Los Angeles County, California, more particularly described as follows: Beginning at the point of intersection of the center line of that certain County Road of variable width, known and called Santa Ana Road, as said Santa Ana Road is shown on a map attached to a lease to the United States of America recorded September 27, 1941 in Book 1107, page 536 of Official Records with the Southerly line of said Lot 11 of Berry Rancho, said point of beginning being located at Coordinate Station North 1000.00 and East 967.50 as per Plane Coordinate System established by the United States Army Engineers for the Santa Ana Army Air Base; thence East along the Southerly line of said Lot 11 and along the grid line North 1000.00 of said Coordinate System 1533.00 feet to Coordinate Station North 1000.00 and East 2500.50; thence North 0° 21' 30" East along a line parallel with said center line of Santa Ana Road, 2030.00 feet to Coordinate Station North 3029.96 and East 2513.20; thence West along a line parallel with the said Southerly line of Lot 11, 1533.00 feet to the center line of said Santa Ana Road and Coordinate Station North 3029.96 and East 980.20; thence South 0° 21' 30" West along said center line of Santa Ana Road 2030.00 feet to the point of beginning. B. Beginning at a point in the Easterly line of Fairview Road, said point being 50.00 feet from the center line of Fairview Road and 67.00 feet Northerly from the center line of Arlington Drive; thence Easterly along a line parallel to the center line of Arlington Drive a distance of 20.00 feet; thence Northerly 176.00 feet to a point which is 70.00 feet Easterly from the center line of Fairview Road; thence Northerly a distance of 390.00 feet to a point which is 60.00 feet from the center line of Fairview Road; thence Northerly along a line parallel to the center line of Fairview Road to a point which is 115.00 feet Southerly from the Northerly line of the property described; thence Northerly 115.00 feet to a point which is 55.00 feet Easterly from the center line of Fairview Road; thence Westerly along said Northerly line a distance of 5.00 feet to a point in the Easterly line of Fairview Road, 50.00 feet in width; thence Southerly along a line parallel to the center line of Fairview Road to the point of beginning. PARCEL 5-A: That portion of Lot 8 of the Berry Rancho, as shown on a Map recorded in Book 9, page 7 of Miscellaneous Records, in the office of the County Recorder of Los Angeles County, California, described as follows: Beginning at the intersection of a line parallel with and distant 33 feet Easterly measured at right angles, from the center line of Fairview Avenue and the Westerly prolongation of the Northerly line of the Newport Union High School District property as shown on a Map recorded in Book 34, page 46 of Record of Surveys in the office of the County Recorder of Orange County, California; thence North 0° 21' 30" East 448.60 feet along said parallel line; thence East 337.19 feet; thence South 448.60 feet to said Northerly line; thence West 340.00 feet along said North line to the point of beginning. The portion to be condemned is described as: Beginning at a point in the Northerly line of the Newport Union High School District property as shown on a Map recorded in Book 34, page 46 of Record of Surveys in the County Recorder of Orange County, said point being 50.00 feet from the center line of Fairview Road; thence Easterly along said Northerly line a distance of 5.00 feet; thence Northwesterly along a line to a point which is 85.00 feet Northerly of the Northerly line as shown in Book 34, page 46; thence Southerly along the Easterly line of Fairview Road 50.00 feet in width to the point of beginning. PARCEL 6-A: That portion of Lots 6, 7 and the Westerly 1 acre of Lot 8, said acre being measured to the center line of the adjacent street on the North, in Block "A" of the Berry Tract, as shown on a map recorded in Book 9, page 6 of Miscellaneous Records of Los Angeles County. Excepting therefrom a strip along the Northerly line conveyed to the County of Orange by deed recorded February 15, 1943 in Book 1174, page 533 of Official Records of said Orange County. Also excepting therefrom the Southerly 100.00 feet of Lot 6 and the Southerly 100.00 feet of the Westerly 100.00 feet of Lot 7 thereof. Also excepting therefrom that certain land described in Deed to Stater Bros. Markets, a California corporation, recorded January 5, 1968 in Book 8484, page 180 of Official Records of Orange County, California. The portion to be condemned is described as: Beginning at the Northwest corner of said Lot 6, said Northwest corner being the point of intersection of the center line of Fairview Road with the center line of Baker Street, as said center lines are shown on a map filed in Book 17, page 46 of Parcel Maps in the office of the County Recorder of said Orange County, California; thence South 0° 21' 40" West along the center line of Fairview Road a distance of 260.00 feet; thence South 89° 16' 00" East a distance of 70.00 feet to a point being the true point of beginning; thence South 2° 22' 24" West 284.72 feet to a point in a line that is parallel with and distant Easterly 60.00 feet, measured from said Westerly line; thence South 0° 21' 40" West along said last mentioned parallel line 181.04 feet to a point in the Southerly line of Parcel 1 as shown on a map filed in Book 17, page 46 of Parcel Maps, in the office of the County Recorder of Orange County, California; thence North 890 16' 50" West along said Southerly line 10.00 feet to a point in a line that is parallel with and distant Easterly 50.00 feet, measured at right angles from said Westerly line of Lot 6; thence North 0° 21' 40" East parallel with said Westerly line 465.64 feet; thence South 89° 16' 00" East a distance of 20.00 feet to the true point of beginning. Thence North 0° 25' 40" East along said center line of Fairview Road a distance of 442.48 feet, thence South 89° 16' 00" East 529.37 feet, thence South 0° 44' 00" West 190.00 feet; thence South 890 16' 00" East 260.00 feet; thence South 00 44' 00" West along a line parallel with and 944.00 feet Westerly of the Westerly line of said Tract No. 4232, a distance of 252.47 feet to the center line of said Baker Street; thence North 89° 16' 00" West along said center line 787.01 feet to the point of beginning. PARCEL 11-A: Parcel 1: Lots 197 to 206, both inclusive, of Tract No. 2671, as shown on a Map recorded in Book 86, pages 30, 31 and 32 of Miscellaneous Maps, records of Orange County, California. Parcel 2: That portion of Lot 1 of Tract No. 421 as shown on a Map recorded in Book 30, page 26 of Miscellaneous Maps, records of Orange County, California, shown as "Not a part of this subdivision" on the Map of Tract No. 2671 recorded in Book 86, pages 30, 31 and 32 of Miscellaneous Maps, records of Orange County, California. All that land lying Southeasterly of a curved line having a radius of 27.00 feet concave Northwesterly and tangent to a line lying 50.00 feet Northerly of and parallel to the center line of Baker Street and tangent to a line lying 70.00 feet Westerly of and parallel to the center line of Fairview Road. B. Beginning at a point said point being 77.00 feet Northerly of the center line of Baker Street and 70.00 feet Westerly of the center line of Fairview Road; thence Easterly along a line parallel with the center line of Baker Street, a distance of 20.00 feet; thence Northerly along the Westerly line of Fairview Road to a point in the Easterly prolongation of the center line of Conway Avenue; thence Westerly along said prolongation a distance of 12.00 feet; thence Southwesterly along a line to the point of beginning. The portion to be condemned is described as: Beginning at a point, said point being 77.00 feet Southerly from the center line of Baker Street and 60.00 feet Westerly from the center line of Fairview Road; thence Easterly parallel with the center line of Baker Street a distance of 10.00 feet; thence Southerly parallel with the center line of Fairview Road to the Southerly boundary of the land described; thence Westerly along said Southerly boundary a distance of 10.00 feet; thence Northerly parallel with the center line of Fairview Road to the point of beginning. PARCEL 13-A: A portion of George W.
