A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, DETERMINING AND DECLARING THAT RUBBISH AND WEEDS
WHICH BEAR SEEDS OF DOWNY OR WINGY NATURE AND WEEDS WHICH
ATTAIN SUCH A LARGE GROWTH AS TO BECOME A FIRE NUISANCE WHEN
DRY AND WEEDS WHICH ARE OTHERWISE NOXIOUS OR DANGEROUS ARE
GROWING UPON CERTAIN STREETS, SIDEWALKS, PARKWAYS AND PRIVATE
PROPERTY IN THE CITY OF COSTA MESA, AND THAT THE SAME ARE A
PUBLIC NUISANCE; DIRECTING THE FIRE CHIEF OR HIS DESIGNEE TO
POST NOTICES TO REMOVE SAID RUBBISH AND DESTROY SAID WEEDS AS
REQUIRED BY LAW; FIXING THE TIME FOR HEARING ALL OBJECTIONS
OR PROTESTS AND DIRECTING THE ABATEMENT THEREOF IN ACCORDANCE
WITH DIVISION III OF ARTICLE 1 OF CHAPTER III, COSTA MESA
MUNICIPAL CODE.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS
FOLLOWS:
THAT WHEREAS, it has come to the attention of the City Council of the
City of Costa Mesa that certain rubbish exists and weeds more particularly
described below are growing upon certain streets, sidewalks, parkways and
private property in the City of Costa Mesa and that the same are a public
nuisance; and
WHEREAS, it appears to the City Council of the City of Costa Mesa that
said rubbish and weeds should be abated as a public nuisance in accordance
with the provisions of Division III of Article 1 of Chapter III, Costa Mesa
Municipal Code.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
THAT, pursuant to the provisions of the aforesaid Sections of the Costa
Mesa Municipal Code, the City Council of the City of Costa Mesa hereby
determines and declares that rubbish exists and weeds which bear seeds of a
downy or wingy nature, and weeds which attain such large growth as to become
a fire nuisance when dry, and weeds which are otherwise noxious or dangerous,
are growing upon certain streets, sidewalks, parkways and private property
in said City as more particularly described hereinafter, and that the same
are hereby declared to be a public nuisance, and that the names of such
streets as they are commonly known are designated on a list attached hereto
and made a part of this Resolution, and that the property fronting upon said
streets, sidewalks or parkways, or in front of which such nuisance exists,
are hereinafter described in accordance with said list used in describing
the property for taxation purposes.
BE IT FURTHER RESOLVED, that the Fire Chief or his designee is hereby
designated as the person or persons to give notice to remove such rubbish
and destroy said weeds, said notice to be in accordance with the terms of
Section 3100.4 through and including Section 3100.8, Costa Mesa Municipal
Code.
BE IT FINALLY RESOLVED, that the City Council does hereby fix the 19th
day of March, 1973, at the hour of 6:30 p.m., as the time, and the Council
Chamber in the City Hall, 77 Fair Drive, Costa Mesa, California, as the
place for hearing objections and protests to the proposed removal of such
rubbish and weeds.
PASSED AND ADOPTED this 20th day of February, 1973.

regularly passed and adopted by the City Council of the City of Costa
Mesa at a regular meeting held on the 20th day of February, 1973.
