HomeMy WebLinkAbout73-49 - Opposing Legislature Introduced Containing Exemptions from SB 90RESOLUTION NO. 73-49 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA OPPOSING THE INTRODUCTION OF BILLS BY THE STATE LEGISLATURE CONTAINING EXEMPTIONS FROM SENATE BILI, 90 REIMBURSEMENT PROVISIONS. WHEREAS, the 1972 Legislature enacted Senate Bill 90, Reagan - Moretti Tax Reform Program, which among other things provides that the maximum property tax rate limitation is the rate levied by a city for the 1972-73 fiscal year; and WHEREAS, Senate Bill 90 provides further that the State is obligated to pay the full cost of any new State -mandated local programs enacted after January 1, 1973, Revenue and Taxation Code Section 2164.3; and WHEREAS, certain Senate and Assembly bills have been and are being introduced containing "State -mandated local programs" and which have written into them provisions purporting to exempt the bills from the Senate Bill 90 reimbursement provisions, more commonly referred to as "SB 90 disclaimers;" and WHEREAS, the "SB 90 disclaimers" are in direct conflict with the spirit and intent of the "Reagan -Moretti Tax Reform Program" and in effect make the program meaningless and a subterfuge; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa Mesa hereby expresses its strong opposition to the use of "SB 90 disclaimers" by Senators and Assemblymen introducing "State -mandated local programs" legislation; and BE IT FURTHER RESOLVED that the City Council of the City of Costa Mesa urges that all Senators and Assemblymen go on record publicly in opposition to the practice of using "SB 90 disclaimers" and that the Governor veto all bills containing such language; and BE IT FURTHER RESOLVED that any and all State -mandated local programs adopted by the Legislature of the State of California contain no clause which may be construed as a disclaimer of the requirements of Senate Bill 90; and BE IT FURTHER RESOLVED that all Legislation adopted by the State Legislature mandating local programs contain therein the methods and means by which either the State of California fund the costs to be incurred in such programs, or that the local agency be authorized to exceed any maximum property tax rate limitation set by the Legislature for funding said programs; and BE IT FINALLY RESOLVED that the City Clerk is hereby authorized and instructed to transmit certified copies of this resolution to Governor Ronald Reagan, Speaker of the Assembly Bob Moretti, Senator Dennis E. Carpenter, Assemblyman Robert E. Badham, the League of California Cities, with instructions that it be published in their "Legislative Bulletin," members of the Senate and Assembly Committees on Local Government, and all of the cities of Orange County.
