A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA
MESA, CALIFORNIA, DECLARING ITS INTENTION TO ORDER
CERTAIN LIGHTING FIXTURES AND APPLIANCES ON CERTAIN
STREETS AND PUBLIC PLACES IN THE CITY OF COSTA MESA,
TO BE MAINTAINED AND ELECTRIC CURRENT TO BE FURNISHED
FOR LIGHTING SAID FIXTURES FOR A PERIOD OF MONTHS,
ENDING JUNE 30, 1977.
THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DOES HEREBY
RESOLVE, DECLARE, DETERMINE, AND ORDER AS FOLLOWS:
SECTION 1. That the public interest and convenience require, and it
is the intention of the City Council of the City of Costa Mesa to install
certain street light standards, appliances, and fixtures, and to order
certain fixtures and appliances on portions of streets, avenues, places,
circles, parkways, courts, ways, and drives within the City as hereinafter
set forth, all as shown on Diagram and Plan No. 74-75 on file in the Office
of the City Clerk, to be maintained and electric current to be furnished
for lighting said fixtures and appliances for a period of months beginning
and ending in accordance with the Report of the City Engineer dated
November 19, 1973, on file in the Office of the City Clerk and which is
hereby referred to and by this reference incorporated herein and made a
part hereof. The period of time for the furnishing of electric current
and maintenance for the fixtures and appliances on each street (or right
of way stated above) shall be set forth in detail in the "Notice of
Improvement," which said Notice the law requires to be both published and
posted.
SECTION 2. That the public interest and convenience require, and it
is the intention of the City Council of the City of Costa Mesa to order
certain fixtures and appliances on portions of streets, avenues, places,
circles, parkways, courts, ways, and drives within said City as hereinafter
set forth, all as shown on Diagram and Plan No. 74-75 on file in the Office
of the City Clerk, to be maintained and electric current to be furnished
for lighting said fixtures and appliances for a period of months, begin-
ning and ending in accordance with the Report of the City Engineer dated
November 19, 1973, on file in the Office of the City Clerk and which
is hereby referred to and by this reference incorporated herein and made
a part hereof. The period of time for the furnishing of electric current
and maintenance for the fixtures and appliances on each street (or right
of way stated above), shall be set forth in detail in the "Notice of
Improvement," which said Notice the law requires to be both published and
posted. Said period of time shall commence on July 1, 1974, and shall end
June 30, 1977, and the period of time that any portion of said service and
maintenance is provided for by the City shall be for the same period com-
mencing on the same date and concluding on the date as heretofore set forth.
SECTION 3. All the work and improvement above specified in Sections
1 and 2 shall be done in accordance with the specifications and plans here-
tofore referred to in the Report of the City Engineer dated November 19,
1973, on file in the Office of the City Clerk and which is hereby referred
to and by this reference incorporated herein and made a part hereof.
SECTION 4. The City Treasurer, having heretofore established a
special fund known as "Street Lighting Electric Current and Maintenance
Fund," shall place in said special fund all moneys collected by the Tax
Collector pursuant to the provisions of Section 7 of this Resolution as
soon as said moneys have been transferred to him. Payments shall be
made out of said special fund only for the purposes provided for in this
Resolution. To expedite the making of this improvement, the City Council
shall transfer into said special fund, out of any money in the general
fund, such sums as it may deem necessary, and the sums so transferred shall
be deemed a loan to such special fund and shall be repaid out of the pro-
ceeds of the assessments provided for in this Resolution.
SECTION 5. Whereas the said contemplated work and improvement, in
the opinion of the City Council, is of more than local or ordinary benefit;
said Council hereby makes the expense of said work and improvement charge-
able upon a district, which district said Council hereby declares to be
the district benefited by said work and improvement, and to be assessed
to pay the cost and expense thereof, which said district is the incorporated
City of Costa Mesa as shown on Diagram and Plan No. 74-75 on file in the
office of the City Clerk, on which map the extent of said assessment
district is indicated, and the exterior boundaries thereof are described, -�
by a colored boundary line, and to which said map reference is hereby made
for a complete and detailed description of said district, excepting from
said district any portion of any public street or alley which may not
be included therein. The said diagram so on file shall govern for all
details as to the extent of said assessment district.
SECTION 6. Any lots or parcels of land known as public property,
as the same is defined in Section 18014, Part 1, Division 14, of the Streets
and Highways Code of the State of California, (Street Lighting Act of 1919),
hereinafter referred to, which are included in the said assessment district,
shall be omitted and exempt from the assessment to be made to cover the
costs and expenses of said contemplated improvement.
SECTION 7. The improvement contemplated by this Resolution of
Intention shall be done under the provisions of the "Street Lighting Act
of 1919," being Part 1 of Division 14 of the Streets and Highways Code of
the State of California, as amended, and under the alternative procedure
for levying and collecting assessments on ad valorem basis, provided for
in Chapter 8.5 of the Street Lighting Act of 1919.
SECTION 8. That this Resolution shall take effect immediately.
SECTION 9. That the City Clerk shall certify to the adoption of
this Resolution.

being Resolution No. 73-126, was considered section by section and that
said Resolution was then passed and adopted as a whole by the following
roll call vote, to wit:
