HomeMy WebLinkAbout73-144 - Adopting GP-73-02, Dates for Amending Mandatory ElementsRESOLUTION NO. 73-144 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ADOPTING GENERAL PLAN AMENDMENT GP -73-02, ES- TABLISHING DATES FOR AMENDING MANDATORY ELEMENTS OF THE GENERAL PLAN; ESTABLISHING PROCEDURES FOR DETERMINING CONSISTENCY OF THE ZONING ORDINANCES WITH THE GENERAL PLAN; ESTABLISHING CRITERIA FOR AND THE DATE OF THE PLANNING COM- MISSION ANNUAL REPORT TO THE CITY COUNCIL ON THE PROGRESS OF THE GENERAL PLAN; AND DIRECTING THE PLANNING COMMISSION TO PROMOTE PUBLIC INTEREST IN AND UNDERSTANDING OF THE GENERAL PLAN AND ITS RELATED REGULATIONS. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HERBY RESOLVE AS FOLLOWS: WHEREAS, Section 65361 of the Government Code states that no mandatory element of a General Plan shall be amended more frequently than three times during any calendar year; and WHEREAS, Section 65860 of the Government Code states that City zoning ordinances shall be consistent with the General Plan of the City by January 1, 1974; and WHEREAS, Sections 65400 and 34217 of the Government Code require the Planning Commission to submit an annual report to the City Council on the progress of the General Plan, and to indicate the degree to which the General Plan complies with the guidelines adopted by the Council on Intergovernmental Relations; and WHEREAS, Section 65400 of the Government Code requires that the Planning Commission shall endeavor to promote public interest in and understanding of the General Plan and its regulations. NOW, THEREFORE, BE IT RESOLVED that General Plan Amendment GP -73-02 is hereby approved and adopted; and BE IT FURTHER RESOLVED that in compliance with the limitations placed upon the City Council by the Government Code, amendments to mandatory elements of the Costa Mesa General Plan shall be considered only at the first regular Council meeting in February, June, and October of each Calendar year. BE IT FURTHER RESOLVED that the following procedures are established for determining consistency of zoning districts with the General Plan: I Consistency Based on AppropriateZoninS Classifications General Plan Designation Low Density Residential Medium Density Residential High Density Residential Neighborhood Commercial General Commercial Commercial Center Industrial Park Light Industrial Golf Course Public and Semi -Public Consistent Zoning_ Classification R1, R1 -W, Al, I and R Rl, R2, I and R R2, R3, R4, R4 -W, I and R Cl, AP, P Cl, C2, AP, P Cl, C1S, AP, TC, P MP, Ml ML, MG, M1 I and R I and R, CR, P ,.— II Consistency Based on the Adoption of a Specific Plan Pursuant to Sections 65450 - 65553 of the Government Code In certain situations, it may be necessary to phase conversion of one land use district to another by the use of a specific plan. Adoption of a specific plan pursuant to Sections 65450-65553 of the Government Code shall be deemed to meet the test of zoning ordinance consistency with the General Plan. BE IT FURTHER RESOLVED that the Planning Commission shall submit an annual report to the City Council on September 1 of each year on the status of the General Plan, its elements and specifications, and the progress in their application. Said annual report shall also indicate the degree to which the General Plan complies with the guidelines adopted by the Council on Intergovern- mental Relations. BE IT FURTHER RESOLVED that the Planning Commission shall endeavor to promote public interest in and understanding of the General Plan and its related regulations. The Planning Commission shall consult and advise with public officials and agencies, public utility companies, civic, educational, profes- sional, and other organizations, and citizens generally with relation to carrying out the General Plan.
