RESOLUTION NO. 74-8
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 6,
HARBOR BOULEVARD FROM ADAMS AVENUE TO BAKER STREET.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS
FOLLOWS:
WHEREAS, a public hearing was called for February 19, 1974, at the hour of
6:30 p.m., in the Council Chambers in the City Hall, Costa Mesa, California, to
ascertain whether the public necessity, health, safety, or welfare requires .the.
underground installation of wires and facilities for supplying electrical,
communication, or similar or associated service, within that certain area of
Costa Mesa described as follows:
A strip of land 120 feet in width, the centerline of which
is the centerline of Harbor Boulevard and is bounded on the
south by the centerline of Adams Avenue and bounded on the
north by a line 50 feet north from the centerline of Baker
Street.
WHEREAS, notice of such hearing has been given to all affected property
owners as such are shown on the last equalized assessment roll and to all
utilities concerned in the manner and time required by law; and
WHEREAS, such hearing has been duly and regularly held and all persons
interested have been given an opportunity to be heard.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa
Mesa that pursuant to Ordinance No. 68-21 of the City of Costa Mesa, the above
described area is hereby declared an Underground Utility District and is
designated as Underground Utility District No. 6 of the City of Costa Mesa.
Attached hereto marked Exhibit "A" and hereby incorporated as a part of this
Resolution, is a map delineating the boundaries of said District;
BE IT FURTHER RESOLVED that the City Council does hereby fix July 1, 1975,
as the date on which affected property owners must be ready to receive under-
ground service, and does hereby order the removal of all poles, overhead wires,
and associated overhead structures, and the underground installation of wires
and facilities for supplying electrical, communication, or similar or associated
service within Underground Utility District No. 6, on September 1, 1975.
BE IT FURTHER RESOLVED that the following exceptions in said Underground
Utility District No. 6 be, and they are hereby authorized:
(1) Any municipal facilities or equipment installed under the
supervision and to the satisfaction of the City Engineer.
(2) Poles or electroliers used exclusively for street lighting
(or traffic signals).
(3) Overhead wires (exclusive of supporting structures) crossing
any portion of a District within which overhead wires have
been prohibited, or connecting to building on the perimeter
of a District, when such wires originate in an area from
which poles, overhead wires, and associated overhead struc-
tures are not prohibited.
(4) Poles, overhead wires, and associated overhead structures used
for the transmission of electric energy at nominal voltages
in excess of 34,500 volts.
(5) Antennae, associated equipment, and supporting structures, used
by a utility for furnishing communication services.

(6) Equipment appurtenant to underground facilities such as
surface -mounted transformers, pedestal -mounted terminal boxes
and meter cabinets, and concealed ducts.
(7) Temporary poles, overhead wires, and associated overhead
structures used or to be used in conjunction with construction
projects.
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to
notify all affected utilities and all persons owning real property within
Underground Utility District No. 6 of the adoption of this Resolution within
ten (10) days after the date of such adoption. Said City Clerk shall further
notify said property owners of the necessity that, if they or anv person
occupying such property desires to continue to receive electric, communication,
or other similar or associated service, they or such occupant shall, by the
date fixed in this Resolution, provide all necessary facility changes on their
premises so as to receive such from the lines of the supplying utility or
utilities at a new location, subject to applicable rules, regulations, and
tariffs of the respective utility or utilities on file with the Public
Utilities Commission of the State of California. Such notification shall be
made by mailing a copy of this Resolution, together with a copy of said
Ordinance No. 68-21, to all affected property owners as such are shown on the
last equalized assessment roll and to the affected utilities;
BE IT FINALLY RESOLVED that the City Council hereby finds and determines
as follows:
The Underground Utility District herein created is in the general public
interest for the following reasons:
(1) The undergrounding will avoid or eliminate an unusually
heavy concentration of overhead distribution facilities.
(2) The streets and rights of way in the District are
extensively used by the general public and carry a
heavy volume of pedestrian and vehicular traffic.
PASSED AND ADOPTED this 19th day of February, 1974.
