HomeMy WebLinkAbout74-31 - Supporting Senate Bill 237, Punishment When Felonies Committed with FirearmsI RESOLUTION NO. 74-31 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, SUPPORTING SENATE BILL 237 AS AMENDED RELATING TO PROBATION AND PUNISHMENT WHEN FELONIES HAVE BEEN COMMITTED WITH FIREARMS, AND GIVING REASONS THEREFOR. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, Senate Bill 237, as amended, of the California Legislature amends Section 1203 of the Penal Code, relating to probation of persons convicted of crimes when using or carrying firearms during the commission of violent felony crimes, or any person who has been convicted of violating Section 11352 of the Health and Safety Code by selling or offering to sell heroin or cocaine; and WHEREAS, during the period between 1967 and 1972, 71.2 percent of the State's convicted felony offenders were let off with probation instead of jail or prison; and WHEREAS, said Senate Bill 237 has been reviewed and supported by the Police Department and the City Attorney's office, and such organizations as the California Peace Officers Association, and the California District Attorneys Association are solidly in support of said Senate Bill; and WHEREAS, Senate Bill 237 was killed in the Assembly Criminal Justice Committee on March 14, 1973, and since that time action has been taken by the people of the State of California to place on the ballot an initiative measure to be voted upon directly by the voters; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa Mesa hereby goes on record in support of Senate Bill 237, as amended in the Assembly on February 14, 1974. BE IT FURTHER RESOLVED that a copy of this Resolution supporting Senate Bill 237 be forwarded to the Senate and Assembly representatives for the City of Costa Mesa in Sacramento. BE IT FURTHER RESOLVED that copies of this Resolution be forwarded to members of the Senate Judiciary Committee; the Assembly Criminal Justice Committee; Attorney General Evelle J. Younger; and the League of California Cities.
