RESOLUTION NO. 74-56
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA RELATING TO THE RESPONSIBILITY FOR
THE DAMAGES TO A VICTIM OF A CRIME OF VIOLENCE;
ESTABLISHING FINANCIAL RESPONSIBILITY ON THE
PERPETRATOR OF A CRIME OF VIOLENCE RESULTING IN
INJURY TO PERSON AND PROPERTY OF OTHERS; AND
ESTABLISHING REASONS THEREFOR.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS
FOLLOWS:
THAT, WHEREAS, the State Board of Control will now honor claims
for damages from victims of violent crimes; and
WHEREAS, said claims are ultimately paid by the taxpayers of the
State of California; and
WHEREAS, the initial responsibility for making said victims whole,
lies with the perpetrator of the crime which caused the damage.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Costa Mesa urges the Legislature of the State of California to require
the perpetrator of a crime of violence to be initially and ultimately
responsible for restoring the victim to as near as possible his condi-
tion before the crime was committed;
BE IT FURTHER RESOLVED that a part and portion of every sentence
imposed by a Court of Law in connection with a crime of violence should
be provisions for a restitution to the victim;
BE IT FURTHER RESOLVED that any probationary period imposed by a
Court of Law as a part of a sentence for the commission of a violent
crime should be for the full period of time necessary for the felon to
produce the damages necessary to make restitution to the victim;
BE IT FURTHER RESOLVED that the Legislature of the State of Cali-
fornia be urged to enact legislation to make the perpetrator of a crime
of violence initially and ultimately responsible for the damages suf-
fered by the victim;
BE IT FINALLY RESOLVED that a copy of this Resolution be forwarded
to the Governor of the State of California, the Senator representing the
Senatorial District wherein lies the City of Costa Mesa; and to all
Assemblymen sharing a portion of the City of Costa Mesa in their Assembly
Districts.
PASSED AND ADOPTED this 6th day of August, 1974.
