HomeMy WebLinkAbout75-53 - Intent to Annex Paularino-Bear Annexation to the Park & Recreation District, Setting Public Hearing:,18 RESOLUTION NO. 75-53 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ACTING AS THE EX -OFFICIO BOARD OF DIRECTORS OF THE COSTA MESA PARK AND RECREATION DISTRICT, GIVING NOTICE OF INTENTION TO ANNEX, AND SETTING A PUBLIC REARING FOR THE CONSIDERATION OF WRITTEN PROTESTS AGAINST PAULARINO-BEAR ANNEXATION AND OTHERWISE PROVID- ING THEREFOR. THE CITY COUNCIL OF THE CITY OF COSTA MESA, ACTING AS THE EX - OFFICIO BOARD OF DIRECTORS OF THE COSTA MESA PARK AND RECREATION DIS- TRICT, DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, on the 12th day of March, 1975, the Local Agency Forma- tion Commission, after due notice and public hearing as required by law, approved the proposed annexation of the Costa Mesa Park and Recreation District, designated as Paularino-Bear Annexation; and WHEREAS, pursuant to Section 35305, Government Code, not less than ane -fourth of the landowners in the territory have signed and filed with the City Clerk petitions requesting said annexation; and WHEREAS, the City Council desires to set a date for hearing of written protests, if any, against said annexation; and WHEREAS, Section 35307, Government Code, provides that said hearing shall be not less than 40 nor more than 60 days after the passage of said Resolution; NOW, THEREFORE, BE IT RESOLVED that Paularino-Bear Annexation, a true and correct legal description of which is attached to this Resolu- tion marked Exhibit "A" and by this specific reference made a part hereof, is to be annexed to the Costa Mesa Park and Recreation District and to become a part and portion of its corporate limits. BE IT FURTHER RESOLVED that a public hearing, for the purpose of hearing written protests by owners of property within said annexed territory, shall be set for the 1st day of July, 1975, at 6:30 p.m., or as soon thereafter as practicable. BE IT FURTHER RESOLVED that all hearings made reference to herein shall take place at the City Hall at 77 Fair Drive, Costa Mesa, Cali- fornia. BE IT FURTHER RESOLVED that a copy of this Resolution, when passed, be submitted to the governing board of each school district, which in part or whole is included in the territory thought to be included in the District, providing said school governing board has made a written request therefor. BE IT FINALLY RESOLVED that a copy of this Resolution be made a part of the permanent records of the City of Costa Mesa. PASSED AND ADOPTED this 20th day of May, 1975. W al— Deputy City Clerk of the City of Costa Mesa i j PAULARINO-BEAR ANNEXATION TO THE COSTA MESA PARK AND RECREATION DISTRICT Those portions of Lot 1, Block "C", and Lot 1, Block "B", of the Berry Tract, in the County of Orange, State of California, as per map recorded in Book 9, Page 6 of Miscellaneous Records of Los Angeles County, California, described as follows: Beginning at an angle point in the existing boundary line of Costa Mesa Park and Recreation District, as adopted by Orange County Board of Supervisors Resolution No. 61-1144, said angle point being distant south 89°37'57" east, 543.36 feet and south 0°29'25" west, 200.00 feet from the centerline intersection of Bear Street and Gisler Avenue; Thence along said existing boundary line of Costa Mesa Park and Recreation District, per Resolution No. 61-1144, Annexation adopted by the Costa Mesa City Council per Resolution No. 62-24, Paularino No. 8 Annexation, adopted by the Costa Mesa City Council per Resolution No. 66-16, and said Resolution No. 61-1144 through its various courses in a general southerly, westerly, northerly, easterly, northerly, and easterly direction to a point in the existing boundary line of said District being distant north 0°29'25" east, 200.00 feet from the point of beginning; Thence leaving said existing boundary line of Costa Mesa Park and Recreation District along said last mentioned course south 0°29'25" west, 200.00 feet to the Point of Beginning.
