A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, DECLARING ITS INTENTION
TO DISPOSE OF SURPLUS REAL PROPERTY; DESCRIBING
THE LAND TO BE SOLD; SETTING FORTH IN GENERAL
TERMS THE INTEREST EASEMENTS OR RESERVATIONS TO
BE RESERVED BY THE PUBLIC, IF ANY; SETTING THE
TIME AND PLACE OF THE SALE; ESTABLISHING TERMS
AND CONDITIONS OF THE SALE; AND CALLING FOR
SEALED BIDS IN WRITING.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS
FOLLOWS:
THAT, WHEREAS, Title 1, Division 1, Chapter 1, Article 4.5,
Sections 190 through and including 196 of the Government Code, provide
for a method for the disposition of surplus real property of a local
agency; and
WHEREAS, the City has as surplus certain lands described on an
exhibit attached to this Resolution marked Exhibit "A", and by this
specific reference made a part hereof; and
WHEREAS, said lands are more particularly described in a plat
attached to this Resolution, marked Exhibit "B", and by this specific
reference made a part hereof; and
WHEREAS, the City desires to dispose of said lands to the highest
bidder;
NOW, THEREFORE, BE IT RESOLVED that pursuant to the aforesaid
statutory authority, the City does hereby offer for sale the real
property described in Exhibit "A" attached hereto, and as more partic-
ularly described in the plat marked Exhibit "B" attached hereto.
BE IT FURTHER RESOLVED that said sale shall be in accordance with
the terms and conditions as set forth in the Notice of Sale at Public
Auction attached to this Resolution, marked Exhibit "C", and to the
state of the title as described in Exhibit "D", both by this specific
reference made a part hereof.
BE IT FURTHER RESOLVED that Notice of Sale be published in the
Orange Coast Daily Pilot once a week for four (4) consecutive weeks,
said notice to be published pursuant to Section 6064, Government Code,
and to contain a description of the land or lands to be sold, general
terms, including interests or easements or reservations to be reserve by
the City, the time and place of sale, and a call for sealed bids in
writing.
BE IT FURTHER RESOLVED that all bids shall be filed with the City
Clerk of the City of Costa Mesa at or before 11:00 a.m. on the 2nd day
of June, 1975.
BE IT FURTHER RESOLVED that the opening of said bids take place at
the hour of 11:00 a.m. in the Council Chambers of the City of Costa
Mesa, 77 Fair Drive, Costa Mesa, California, on the 2nd day of June,
1975.
BE IT FINALLY RESOLVED that the money derived from said sale be
forthwith paid into the fund from which payment was made for the land.

foregoing Resolution No. 75-40 was duly and regularly passed and adopted
by the said City Council at a regular meeting thereof, held on the 15th
day of April, 1975.

Miscellaneous Maps, records of Orange County, California.
Reserving therefrom, a perpetual easement for public street and highway
purposes over, under, across, and through the following:
Beginning at the northwest corner of said Lot 17; thence south
0° 32' 40" east a distance of 64.95 feet to the beginning of a
tangent curve concave northeasterly having a radius of 15.00 feet;
thence southeasterly along said curve through a central angle of
89° 59' 00" an arc distance of 23.56 feet to a tangent line; thence
north 89° 28' 20" east a distance of 8.00 feet to a point of cusp
with a tangent curve concave northeasterly having a radius of 15.00
feet; thence northwesterly along said curve through a central angle
of 89° 59' 00" an arc distance of 23.56 feet to a tangent line;
thence, along a line parallel and 38 feet easterly of the centerline
of Placentia Avenue, north 0° 32' 40" west a distance of 64.95 feet
to the north line of said Lot 17; thence along said line, south
89° 28' 20" west a distance of 8.00 feet to the Point of Beginning.
Subject to all Covenants, Conditions, Restrictions, Rights, Rights -of -
Way, and Easements of Record, if any.

NOTICE OF SALE AT PUBLIC AUCTION
WHAT:

Public sale of an R-3 zoned parcel
of land containing approximately
5,160 square feet, net, located at
the northeast corner of Scott Place
and Placentia Avenue, in the City
of Costa Mesa (see map attached
marked EXHIBIT "B"), which is
improved with a triplex containing
three two-bedroom one -bath units
with garages.
11:00 a.m., Monday, June 2, 1975
$45,000.00
A Bidder's Deposit in the amount
of $4,500.00 and in the form of
a Cashier's Check must be sub-
mitted with the written bid, or
prior to oral bidding if no
written bid is submitted.
If your offer is accepted, the
Bidder's Deposit will be applied
to the down payment. Deposits
of the unsuccessful bidders will
be refunded.
The Cashier's Check should be
made payable to the City of
Costa Mesa.
Down Payment: Twenty percent (20%) of the total
amount bid must be paid within
seven (7) days of June 2, 1975,
by the bidder who has been noti-
fied that he is the apparent
qualified high bidder.

No person will be allowed to
participate in oral bidding
unless he has posted the required
Bidder's Deposit. Each successive
oral bid will be in a minimum of
$100.00 increments.

Shape and Topography: Rectangular and level. This
parcel has approximately 65
feet of frontage on Placentia
Avenue.
Zoning: R-3, City of Costa Mesa. For
detailed zoning information,
contact the City Planning Depart-
ment.
Utilities: All utilities are in and paid for.
Neighborhood: To the north, east, and south are
multiple family residential units
intermixed with single-family
residences, while to the west are
the school district offices and a
mixture of newer multi -family and
single-family residences.

EXHIBIT "C"
Resolution 75-40
1. General and Special Taxes for the fiscal year 1974-1975 a lien not
yet payable.
2. An easement for public utilities and incidental purposes as shown
upon the map of said tract, over the north five feet of said land.
3. Covenants, conditions, restrictions, but deleting restrictions, if
any, based on race, color, religion, or national origin, in an
instrument recorded in Book 3606, Page 433, Official Records.
The covenants, conditions, and restrictions referred to above
provide that a violation thereof shall not defeat or render invalid
the lien of any mortgage or deed of trust made in good faith and
for value.
An instrument declaring a modification of said covenants, conditions,
and restrictions was recorded in Book 6724, Page 543, Official
Records.
4. An easement in favor of the Pacific Telephone and Telegraph Company,
for underground conduits, and incidental purposes as set forth in
an instrument recorded in Book 3652, Page 434, Official Records,
over the northerly five feet of said land.
Said instrument provides that no building or structures shall be
erected on said easement.
5. An easement for either or both pole lines, conduits and incidental
purposes as set forth in an instrument recorded in Book 3665, Page
65, Official Records, over the northerly six feet of said land.
6. A perpetual easement for public street and highway purposes over,
under, across, and through the following:
Beginning at the northwest corner of Lot 17, Tract No. 2924,
per map thereof recorded in Book 91, Page 8 of Miscellaneous
Maps, records of Orange County; thence south 0° 32' 40" east
