HomeMy WebLinkAbout75-76 - Acquisition, Exxon Corporation, Declared Public StreetRESOLUTION NO. 75-76 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, DECLARING A PORTION OF A RECENT ACQUISITION OF REAL PROPERTY TO BE A PUBLIC STREET; AUTHORIZING THE RECORDING OF SAID RESO- LUTION, AND DECLARING REASONS THEREFOR. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: THAT, WHEREAS, in connection with the acquisition of certain right-of-way on the southeast corner of Fair Drive and Fairview Road in the City, from Exxon Corporation, it became necessary to acquire substitute acreage along the easterly property lines of the Exxon parcel from the Costa Mesa County Water District; and WHEREAS, in compliance with the Master Plan of Streets and High- ways, it is necessary to dedicate or declare a portion of the properties so acquired to be for public street purposes; NOW, THEREFORE, BE IT RESOLVED that the following described real property is hereby dedicated to, and is to be used for, public street and highway purposes: "That portion of Lot "A" of the Banning Tract, in the Rancho Santiago de Santa Ana, as partitioned March, 1890, Case No. 6385, in the Superior Court of Los Angeles County, California, described as follows: BEGINNING at the centerline intersection of Fairview Road (formerly Santa Ana Road) and Fair Drive; thence along the centerline of Fair Drive east a distance of 230.00 feet to a point; thence south 00° 09' 00" west a distance of 50.00 feet to the TRUE POINT OF BEGINNING; thence continuing south 00° 09' 00" west a distance of 10.00 feet; thence west 20.00 feet; thence north 00° 09' 00" east a distance of 10.00 feet; thence east a distance of 20.00 feet to the TRUE POINT OF BEGINNING. All as more particularly shown on a map attached hereto and made a part hereof." BE IT FURTHER RESOLVED that upon acquisition of the real property described herein and the adoption of this Resolution, the same be pre- sented to the Recorder for the County of Orange for recording purposes; BE IT FINALLY RESOLVED that said parcel of property, subject to the sovereign right of the City to vacate said public street, be irrevocably dedicated in perpetuity for street purposes.
