RESOLUTION NO. 75-92
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF COSTA MESA, CALIFORNIA, ESTABLISHING
UNDERGROUND UTILITY DISTRICT NUMBER NINE ON
ADAMS AVENUE FROM HARBOR BOULEVARD TO 570
FEET WEST OF MESA VERDE DRIVE EAST.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS
FOLLOWS:
WHEREAS, a public hearing was called for September 2, 1975, at the
hour of 6:30 p.m., in the Council Chambers of the City Hall, Costa Mesa,
California, to ascertain whether the public necessity, health, or
welfare requires the underground installation of wires and facilities
for supplying electrical, communication, or similar or associated
service, within that certain area of Costa Mesa described as follows:
A strip of land 160 feet in width, being 80 feet
on each side of the centerline of Adams Avenue,
said centerline described as follows:
Beginning at a point on the centerline of Adams
Avenue 60 feet westerly of the centerline inter-
section of Harbor Boulevard and said Adams Avenue;
thence westerly along said centerline of Adams
Avenue to a point 570 feet westerly of the center-
line intersection of Mesa Verde Drive East and
Adams Avenue.
All as more particularly shown on the map attached
hereto and made a part hereof. ■
WHEREAS, notice of such hearing has been given to all affected J
property owners as such as shown on the last equalized assessment roll
and to all utilities concerned in the manner and time required by law;
and
WHEREAS, such hearing has been duly and regularly held and all
persons interested have been given an opportunity to be heard.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Costa Mesa, that pursuant to Title 13, Chapter VIII, Sections 13-684
through 13-700, Costa Mesa Municipal Code, the above described area is
hereby declared an Underground Utility District and is designated as
Underground Utility District No. 9 of the City of Costa Mesa. Attached
hereto marked Exhibit "A" and hereby incorporated as a part of this
Resolution is a map delineating the boundaries of said District;
BE IT FURTHER RESOLVED that the Council does hereby fix January 1,
1977, as the date on which affected property owners must be ready to
receive underground service, and does hereby order the removal of all
poles, overhead wires, and associated overhead structures, and the
underground installation of wires and facilities for supplying elec-
trical, communication, or similar or associated service within Under-
ground Utility District No. 9 on March 1, 1977.
BE IT FURTHER RESOLVED that the following exception in said Under-
ground Utility District No. 9 be, and they are hereby authorized:
(1) Any Municipal facilities or equipment installed under the
supervision and to the satisfaction of the City Engineer.
(2) Poles or electroliers used exclusively for street lighting
(or traffic signals).
(3) Overhead wires (exclusive of supporting structures) crossing
any portion of a District within which overhead wires have
been prohibited, or connecting to building on the perimeter
of a District, when such wires originate in an area from which
poles, overhead wires, and associated overhead structures are
not prohibited.
(4) Poles, overhead wires, and associated overhead structures used
for the transmission of electric energy at nominal voltages in
excess of 34,500 volts.
(5) Antennae, associated equipment, and supporting structures,
used by a utility for furnishing communication services.
(6) Equipment appurtenant to underground facilities such as
surface -mounted transformers, pedestal -mounted terminal boxes
and meter cabinets, and concealed ducts.
(7) Temporary poles, overhead wires, and associated overhead
structures used or to be used in conjunction with construction
projects.
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to
notify all affected utilities and all persons owning real property
within Underground Utility District No. 9 of the adoption of this Reso-
lution within ten (10) days after the date of such adoption. Said City
Clerk shall further notify said property owners of the necessity that,
if they or any person occupying such property desires to continue to
receive electric, communication, or other similar or associated service,
they or such occupant shall, by the date fixed in this Resolution,
provide all necessary facility changes on their premises so as to
receive such from the lines of the supplying utility or utilities at a
new location, subject to applicable rules, regulations, and tariffs of
the respective utility or utilities on file with the Public Utilities
Commission of the State of California. Such notification shall be made
by mailing a copy of this Resolution, together with a copy of said
Sections 13-684 through 13-700 of the Costa Mesa Municipal Code, to all
affected property owners as such are shown on the last equalized assess-
ment roll and to the affected utilities;
BE IT FINALLY RESOLVED that the City Council hereby finds and
determines as follows:
The Underground Utility District herein created is in the general
public interest for the following reasons:
(1) The undergrounding will avoid or eliminate an unusually
heavy concentration of overhead distribution facilities.
(2) The streets and rights of way in the District are exten-
sively used by the general public and carry a heavy volume
of pedestrian and vehicular traffic.
PASSED AND ADOPTED this 2nd day of September, 1975.
