A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF COSTA MESA, CALIFORNIA, ORDERING THE VACA-
TION OF AN ALLEY, ABUTTING LOTS TWO THROUGH
NINE, TRACT 3749, IN THE GENERAL AREA OF
PRESIDTO DRIVE AND BRISTOL STREET.
WHEREAS, the City Council of the City of Costa Mesa did, on the
5th day of August, 1975, pass and adopt Resolution No. 75-80 entitled: A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA,
DECLARING ITS INTENTION TO ORDER THE VACATION OF AN ALLEY, ABUTTING LOTS
TWO THROUGH NINE, TRACT 3749, IN THE GENERAL AREA OF PRESIDIO DRIVE AND
BRISTOL STREET; and
WHEREAS, pursuant to said Resolution of Intention, the time and
place for hearing all persons interested in or objecting to the proposed
vacation was set for Tuesday, the 2nd day of September, 1975, at the
hour of 6:30 p.m., in the Council Chambers of City Hall, 77 Fair Drive,
Costa Mesa, California; and
WHEREAS, notices of said proposed vacation were duly and regularly
posted as required by law, all pursuant to the provisions of Section
8300 et seq. of the Streets and Highways Code of the State of California;
and
WHEREAS, said date of hearing coming on regularly to be heard, all
persons appearing on the proposed vacation were heard, and said hearing
was closed on the 2nd day of September, 1975; and
WHEREAS, the City Council of the City of Costa Mesa finds and
determines, from all the evidence submitted, that the hereinafter des-
cribed right-of-way is unnecessary for present or prospective street
purposes;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES
ORDER AND RESOLVE AS FOLLOWS:
1. That the hereinafter described right-of-way is unnecessary
for present or prospective street purposes.
2. It is hereby ordered that the following described right-of-way
be, and the same is hereby vacated:
Parcel 1: That portion of the alley as shown on Tract 3749,
per map thereof recorded in Book 131, Pages 20 - 30, inclu-
sive, of Miscellaneous Maps, records of Orange County, Cali-
fornia, abutting Lots 2 through 9, inclusive, and lying
northerly of the following described line:
Beginning at the northeast corner of Lot 5 of said Tract 3749;
thence south 16°11'12" west along the easterly line of said
Lot 5, a distance of 66.41 feet to the point of intersection
of a curve concave northerly having a radius of 85.00 feet, a
radial line through said point bears north 23°36'43" west;
thence westerly along said curve through a central angle of
28°52'47" an arc distance of 42.84 feet to a point of reverse
curvature with a curve concave southerly having a radius of
255.00 feet, a radial through said point bears north 5°16104"
east, said point lying on the southerly line of said Lot 5.
Parcel 2: All those easement rights for public alley purposes
and incidents thereto as both were granted to the City of
Costa Mesa by Director's Quitclaim Deed recorded November 25,
1974, as Document No. 19807, in Book 11293, Page 1409, of
Official Records of Orange County, California.
RESERVING therefrom an easement for all existing underground
and overhead public utilities, together with the right of
ingress and egress for the purpose of maintaining, replacing,
and upgrading said existing public utilities.
PASSED AND ADOPTED this 2nd day of September, 1975.
