HomeMy WebLinkAbout76-16 - Opposing Assembly Bill 15, California Agricultural LandsRESOLUTION NO. 76-16 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA EXPRESSING OPPOSITION TO ASSEMBLY BILL NO. 15 OF THE 1975-76 REGULAR SESSION OF THE CALIFORNIA LEGISLATURE, RELATING TO CALIFORNIA AGRICULTURAL LANDS; CREATING THE AGRICULTURAL RESOURCES COUNCIL AND PROVIDING FOR ITS POWER TO REGULATE LAND USES; PROVIDING FOR METHODS OF TAXATION ON SAID PROPERTY AND EXPRESSING REASONS THEREFOR. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: THAT, WHEREAS, Assembly Bill 15 has been introduced in the Cali- fornia Legislature for the 1975-76 Regular Session; and WHEREAS, said Legislation would provide for the creation of an Agricultural Resources Council as a part and portion of the Office of the Governor of the State of California; and WHEREAS, said Resources Council would have the power under said Act to require cities and counties to map the location and boundaries of agricultural lands; and WHEREAS, said Council would be required to prescribe the various land uses which may be permitted within areas designated as prime agri- cultural land; and WHEREAS, upon designation or certification, said lands could be used only for the prescribed purpose as mandated by the Agricultural Resources Council; and WHEREAS, said Legislation would provide for property taxation by the capitalization of income method based upon the restrictions imposed on said land; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa Mesa is unalterably opposed to said Legislation as being an unreasonable restriction upon agricultural land; BE IT FURTHER RESOLVED that the City Council of the City of Costa Mesa is opposed to said Legislation as being an unreasonable infringe- ment upon the rights of local jurisdictions to regulate land uses; BE IT FURTHER RESOLVED that said Legislation is inadequate in that it violates the due process clauses of the State and Federal Constitu- tions, having made no provision for public hearings, rights of appeal, and other Constitutional protections; BE IT FURTHER RESOLVED that said Legislation is not in the best interests of the health, safety, and welfare of the citizens of the State of California; BE IT FINALLY RESOLVED that a copy of this Resolution in certified form be forwarded to Senator Dennis E. Carpenter and Assemblyman Robert Burke with the strong appeal that said Legislation be opposed. PASSED AND ADOPTED this 2nd day of February, 1976.
