RESOLUTION NO. 76-22
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, ORDERING THE VACATION
OF AN EXCESS ALLEY RIGHT-OF-WAY IN A PORTION OF
LOT 88, NEWPORT HEIGHTS TRACT, LOCATED IN THE
GENERAL AREA OF SEVENTEENTH STREET AND IRVINE
r AVENUE.
[L WHEREAS, the City Council of the City of Costa Mesa did, on the
5th day of January, 1976, pass and adopt Resolution No. 76-5 entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA,
DECLARING ITS INTENTION TO ORDER THE VACATION OF AN ACCESS ALLEY RIGHT-
OF-WAY IN A PORTION OF LOT 88, NEWPORT HEIGHTS TRACT, LOCATED IN THE
GENERAL AREA OF SEVENTEENTH STREET AND IRVINE AVENUE; and
WHEREAS, pursuant to said Resolution of Intention, the time and
place for hearing all persons interested in or objecting to the proposed
vacation was set for Monday, the 2nd day of February, 1976, at the hour
of 6:30 p.m., in the Council Chambers of City Hall, 77 Fair Drive, Costa
Mesa, California; and
WHEREAS, notices of said proposed vacation were duly and regularly
posted as required by law, all pursuant to the provisions of Section
8300 et seq. of the Streets and Highways Code of the State of Cali-
fornia; and
WHEREAS, said date of hearing coming on regularly to be heard, all
persons appearing on the proposed vacation were heard, and said hearing
was closed on the 2nd day of February, 1976; and
WHEREAS, the City Council of the City of Costa Mesa finds and
determines, from all the evidence submitted, that the hereinafter des-
cribed right-of-way is unnecessary for present or prospective street
purposes;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES
ORDER AND RESOLVE AS FOLLOWS:
That the hereinafter described right-of-way is unnecessary
for present or prospective street purposes.
It is hereby ordered that the following described right-
of-way be, and the same is hereby vacated:
A portion of the southwesterly 20.00 feet of Lot 88 of
Newport Heights, as shown on a map thereof recorded in
Book 4, Page 83 of Miscellaneous Maps, Records of
Orange County, California, described as follows:
BEGINNING at the most westerly corner of the north-
westerly 132 feet of the southeasterly 258 feet of
said Lot 88, said corner lying on the northwesterly
line of that certain easement conveyed to the City
of Costa Mesa, recorded March 19, 1959, in Book 4634,
Page 68 of Official Records of Orange County; thence
northeasterly along the northwesterly line of said
northwesterly 132 feet a distance of 20.00 feet to
the TRUE POINT OF BEGINNING; thence southeasterly
along the northeasterly line of said easement a
distance of 132 feet to a point on the northwesterly
line of the southeasterly 126 feet of said Lot 88;
thence southwesterly along said northwesterly line
7.50 feet; thence northwesterly a distance of 132.21
feet to the TRUE POINT OF BEGINNING.
RESERVING therefrom an easement for all existing
underground and overhead public utilities, together
with the right of ingress and egress for the purpose
of maintaining, replacing, and upgrading said existing
public utilities.
PASSED AND ADOPTED this 2nd day of February, 1976.
