HomeMy WebLinkAbout76-39 - Intention to Annex Red Hill Annexation No. 1 to the Park & Recreation District— 1 J RESOLUTION NO. 76-39 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ACTING AS THE EX -OFFICIO BOARD OF DIRECTORS OF THE COSTA MESA PARK AND RECREATION DISTRICT, GIVING NOTICE OF INTENTION TO ANNEX, AND SETTING A PUBLIC HEARING FOR THE CONSIDERATION OF WRITTEN PROTESTS AGAINST RED HILL ANNEXATION NUMBER ONE AND OTHERWISE PROVIDING THEREFOR. THE CITY COUNCIL OF THE CITY OF COSTA MESA, ACTING AS THE EX - OFFICIO BOARD OF DIRECTORS OF THE COSTA MESA PARK AND RECREATION DIS- TRICT. DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, on the 25th day of February, 1976, the Local Agency Formation Commission, after due notice and public hearing as required by law, approved the proposed annexation of the Costa Mesa Park and Recrea- tion District, designated as Red Hill Annexation No. 1; and WHEREAS, the City Council of the City of Costa Mesa finds and determines as follows: (a) That the territory proposed to be annexed is uninhabited. (b) That the proposed annexation will be for the interest of the citizens of the City of Costa Mesa to provide a needed park and recreational area. (c) That the City Council has taken into consideration as a factor, in addition to the factors hereinabove set forth, the Local Agency Formation Commission's approval of the proposed annexation. (d) That the City Council is authorized to proceed with said annexation in accordance with Sections 56320 and 56322, inclusive, of the Government Code of the State of California. (e) That the City Council desires to set a date for hearing of written protests, if any, against said annexation. (f) That Section 56310, Government Code, provides that said hearing shall be not less than fifteen (15) days nor more than sixty (60) days after the passage of said Resolution; NOW, THEREFORE, BE IT RESOLVED that Red Hill Annexation No. 1, a true and correct legal description of which is attached to this Resolution marked "Exhibit A", and by this specific reference made a part hereof, is to be annexed to the Costa Mesa Park and Recreation District and to become a part and portion of its corporate limits. BE IT FURTHER RESOLVED that a public hearing, for the purpose of hearing written protests by owners of property within said annexed territory, shall be set for the 19th day of April, 1976, at 6:30 p.m., or as soon thereafter as practicable. BE IT FURTHER RESOLVED that the hearing made reference to herein shall take place at the City Hall at 77 Fair Drive, Costa Mesa, Cali- fornia. BE IT FURTHER RESOLVED that a copy of this Resolution, when passed, be submitted to the governing board of each school district, which in part or whole is included in the territory thought to be included in the District, providing said school governing board has made a written request therefor. BE IT FINALLY RESOLVED that a copy of this Resolution be made a part of the permanent records of the City of Costa Mesa. PASSED AND ADOPTED this 15th day of March, 1976. IN WITNESS WHEREOF I have hereunto set my hand and affixed the Seal of the City of Costa Mesa this 16th day of March, 1976. i . . o i City Clerk and ex -officio Cler)vfof the City Council of the City of C to Mesa i RED HILL ANNEXATION NO. 1 TO THE COSTA MESA PARK AND RECREATION DISTRICT Beginning at a point in the existing boundary of the Costa Mesa Park and Recreation District, said point being at the southeasterly terminus of that line described as "south 49° 21' 56" east, 224.39 feet" in the Paularino No. 12 Annexation to the Costa Mesa Park and Recreation District, Resolution No. 66-125 adopted December 19, 1966, said point also being at the centerline intersection of Bristol Street (formerly Palisades Road) and Red Hill Avenue as said centerlines are described in said Paularino No. 12 Annexation; thence north 40' 38' 32" east along the centerline of Red Hill Avenue and the existing boundary of the Costa Mesa Park and Recreation District, 1,300.10 feet to the beginning of a tangent curve, concave northwesterly, having a radius of 1,200.00 feet; thence northeasterly and northerly along said curve through a central angle of 44° 56' 03", an arc distance of 941.10 feet; thence north 04° 17' 31" west, 709.07 feet to the beginning of a tangent curve, concave southeasterly, having a radius of 1,200.00 feet; thence norther- ly and northeasterly along said curve through a central angle of 15° 47' 44", an are distance of 330.83 feet to a point in the boundary of Paularino No. 10 Annexation to the Costa Mesa Park and Recreation District, Resolution No. 65-95 adopted November 15, 1965; thence contin- uing along the existing boundary of the Costa Mesa Park and Recreation District and said curve through a central angle of 28° 04' 30", an arc distance of 588.00 feet to a point in the boundary of Paularino No. 7 Annexation to the Costa Mesa Park and Recreation District, Resolution No. 65-20 adopted March 1, 1965; thence continuing along the existing boundary of the Costa Mesa Park and Recreation District and said curve through a central angle of 01° 03' 02", an arc distance of 22.00 feet to the beginning of a tangent line; thence north 40° 37' 45" east, a distance of 1,786.38 feet to a point in the boundary of Paularino No. 11 Annexation to the Costa Mesa Park and Recreation District, Resolution No. 66-62 adopted May 1, 1967; thence continuing along the existing boundary of the Costa Mesa Park and Recreation District, north 40° 37' 45" east, 2,909.24 feet to the southerly line of Parcel No. 1 of an easement granted to the Orange County Flood Control District by deed recorded May 31, 1966, in Book 7946, Pages 708 through 712 of Official Records of said Orange County; thence leaving said District's boundary and following along said southerly line south 85° 26' 04" east, 241.71 feet to the beginning of a tangent curve, concave northerly and having a radius of 218.00 feet; thence easterly 95.22 feet along said curve through a central angle of 25' 01' 36" to the beginning of a reverse curve, concave southerly and having a radius of 182.00 feet; thence easterly 89.95 feet along said reverse curve, through a central angle of 28° 19' 00" to the beginning of a tangent compound curve, concave southerly having a radius of 1,664.00 feet; thence easterly 603.28 feet along said curve through a central angle of 20o 46' 21" to the beginning of a tangent line; thence south 61° 22' 19" east, 43.61 feet to the westerly line of Orange County Airport as granted to the County of Orange by deed recorded in Book 6968, Page 331 of Official Records of said Orange County and as shown on Orange County Surveyor's Map No. 63-1 on file in the Surveyor's office of said Orange County; thence departing from said Orange County Flood Control District's easement south 28° 47' 51" west, 1,314.22 feet along said westerly line as shown on said Surveyor's Map No. 63-1; thence north 61° 12' 03" west, 250.02 feet; thence south 28° 47' 44" west, 2,893.49 feet; thence south 40" 39' 05" west, 1,015.82 feet; thence south 49° 20' 57" east, 212.97 feet; thence south 28° 47' 37" west, 1,769.33 feet; thence south 61° 12' 16" east, 250.01 feet; thence south 28° 47' 47" west, 819.85 feet; thence south 40° 39' 32" west, 1,039.85 feet to the centerline of said Bristol Street (formerly Palisades Road) as described in a deed to the County of Orange recorded in Book 294, Page 271 of deeds, recorded in the office of the County Recorder of said Orange County; thence departing from the westerly line of Orange County Airport as shown on said Surveyor's Map No. 63-1 north 49° 22' 03" west, 1,320.71 feet along said centerline to the POINT OF BEGINNING.
