HomeMy WebLinkAbout76-62 - Reporting Policy for Ambulance and Taxi ApplicationsRESOLUTION NO. 76-62 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA SETTING FORTH REQUIREMENTS FOR REPORT- ING AND POLICY OF ESTABLISHING RATE -MAKING FOR PRIVATELY -FURNISHED PUBLIC SERVICES REGULATED BY THE CITY OF COSTA MESA. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: THAT, WHEREAS, Section 9155 and Section 9248 of the Municipal Code, City of Costa Mesa, authorizes the city Council to fix reasonable rates and service charges pertaining to those privately -furnished public services; and WHEREAS, the City of Costa Mesa recognizes that the public inter- est is best served in fixing reasonable rates and service charges for those privately -furnished public services, provided at least one of the following conditions exists: 1. The maintenance of acceptable service is dependent upon the total available market; 2. The service is mandatory; 3. The service is emergency in nature; 4. The service, because of initial capital requirements, effec- tively eliminates competition; and WHEREAS, the City of Costa Mesa realizes that the rate -making policy of the City Council must permit sufficient flexibility to privately -furnished public service operators to maximize initiative and efficiency while requiring fiscal accountability; and WHEREAS, the privately -furnished public service operation must earn a competitive return on invested capital and the margin of profit, expressed as a percentage of gross revenue, must be sufficient to insure continuity of service; and WHEREAS, the City Council has, by franchise, ordinance, or resolu- tion, established acceptable standards of performance; and WHEREAS, the City Council finds that in order to accomplish the foregoing and enable the City to determine proper rates for said ser- vices that certain information is necessary as to each such privately - furnished public service operation; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa Mesa, California, as follows: 1. That a rate -making policy and a reporting and record -making format, as set forth in Exhibits "A" and "B", which are attached hereto and by this specific reference made a part Lhereof, are hereby adopted for privately -furnished public services in the City of Costa Mesa. 2. That this rate -making policy of the City Council for those privately -furnished public services shall: (a) Provide the public with needed public service at a reasonable rate; (b) Provide the efficient operator of privately -furnished public services with the opportunity to realize a com- petitive return on invested capital and a reasonable margin of profits; (c) Assure the application of uniform rates and service to all classes of consumers; and (d) Be used in support of the financial reporting and record- keeping documents attached hereto. It is expected that the company shall keep its books and financial records in conformance with generally -accepted accounting principles. DATA TO BE SUBMITTED BY COMPANY ON AN ANNUAL BASIS 1. Balance Sheet - Within ninety (90) days following the end of the company's operating year, a balance sheet is to be submitted as prepared by a Certified Public Accountant. 2. Income and Expense Statement - Within ninety (90) days following the end of the company's operating year, an Income and Expense Statement is to be submitted as prepared by a Certified Public Accountant. DATA TO BE SUBMITTED BY COMPANY FOR RATE ADJUSTMENT CONSIDERATION 1. Items 1 and 2 above. 2. An Income and Expense Statement for the three-month period immediately preceding the rate adjustment request as prepared by a Certified Public Accountant. 3. A copy of Schedule "C" of the most recent tax return. 4. A breakdown by year, commencing with 1972, of non - collectibles with an estimate of percentage that may be collectible. EXAMPLE YEAR TOTAL DOLLARS TOTAL DOLLARS PERCENTAGE ACCOUNTS NOT COLLECTED OF COLUMN RECEIVABLE 3 THAT MAY COLLECT 5. Percentage of total revenues receivable, commencing with 1972, from within the City of Costa Mesa. 6. A listing of all ambulance companies operating within Orange County noting specifically the following charges: Response Night Call Mileage Emergency Oxygen Special Handling Resuscitator Wait Time 7. Existing rates both within the City of Costa Mesa and other operating areas. 8. A list of all employee positions by titles. (The City retains the prerogative to review pay schedules on each or all employees.) 9. The company may submit other data it deems pertinent and/or other information. EXHIBIT "A" Resolution No. 76-62 CITY OF COSTA MESA, CALIFORNIA TAXICAB COMPANY FINANCIAL REPORTING AND RECORD KEEPING CITY REQUIREMENT 1. It is expected that the company shall keep its books and financial records in conformance with generally -accepted accounting principles. DATA TO BE SUBMITTED BY COMPANY ON AN ANNUAL BASIS 1. A listing of all taxicab companies operating within Orange County, noting rates specifically for the follow- ing information: FLAG DROP plus First Miles MILEAGE STANDBY OUT-OF-TOWN 7. Existing and projected revenue to drivers per day. Percent commission. 8. A listing of all employee positions by titles. (The City retains the prerogative to review pay schedules on each or all employees.) 9. A statement of taxicab meter limitations. (Increments meters are able to be adjusted to charge.) 10.
