HomeMy WebLinkAbout76-72 - Continuous Offer to Dedicate - Edker and Blanche PopeRESOLUTION NO. 76-72 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ACCEPTING A CONTINUOUS OFFER TO DEDICATE CERTAIN REAL PROPERTY. THE CITY COUNCIL OF THE CITY OF COSTA MESA HEREBY RESOLVES AS FOLLOWS: THAT, WHEREAS, Edker Pope and Blanche Pope, husband and wife, are the holders in community property of the following described real property: "A portion of the northeasterly 140.00 feet of the north- westerly 189.00 feet of Lot 161 of Newport Heights in the City of Costa Mesa, County of Orange, State of California, as shown on a map thereof recorded in Book 4, Page 83 of Miscellaneous Maps, records of Orange County. EXCEPT the northwesterly 139.00 feet thereof, described as: All that land lying within a strip of land lying 60.00 feet southwesterly from the centerline of 19th Street. WHEREAS, on March 21, 1972, Edker and Blanche Pope executed before Roy R. Erickson, a Notary Public, a Continuous Offer to Dedicate the above-described real property to the City of Costa Mesa for street purposes, which offer was duly recorded in Book 10074, Page 797 of the Official Records of the County of Orange, State of California, on April 10, 1972; and WHEREAS, pursuant to the terms of that offer, it was agreed as between the parties that said Offer to Dedicate would be accepted when the City had ascertained that a total program of street widening on 19th Street was a necessity and that the project was definitely to be com- pleted; and WHEREAS, the City of Costa Mesa has now determined that a compre- hensive program of street widening of 19th Street from Park Avenue easterly to Fullerton Avenue shall begin with right-of-way acquisition in the fall of 1976, and with actual construction to commence in the fall of 1977, and that said project shall require the acquisition of the 30 feet of right-of-way herein described. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa Mesa herewith accepts the herein described Continuous Offer to Dedicate. BE IT FURTHER RESOLVED that the Right -of -Way Agent for the City of Costa Mesa be ordered to prepare a right-of-way deed to the real pro- perty herein described and obtain the signatures of the fee owners of the real property herein described upon same. BE IT FURTHER RESOLVED that the City Clerk, upon receipt of said deed, shall record the same in the Official Records of the County of ■r Orange, State of California. L BE IT FURTHER RESOLVED that upon the recordation of said deed, the City staff shall take such steps as are necessary to remove the deeded property from the real property tax rolls of Orange County. BE IT FURTHER RESOLVED that the City staff shall take such steps as are necessary to provide for the removal of any structure or structures located in the right-of-way in accordance with the terms of the Continu- ous Offer to Dedicate of March 21, 1972. �I.AIi Imo_ rv1I BE IT FURTHER RESOLVED that upon the adoption of this Resolution, the City Clerk shall record same in the Official Records of the County of Orange, State of California, and shall mail a true and certified copy thereof by certified mail to the fee owners of the real property herein described.
