A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, ORDERING THE VACATION
OF AN EXCESS RIGHT-OF-WAY IN PORTIONS OF LOTS 79
AND 80 OF TRACT 300, LOCATED IN THE GENERAL AREA
BETWEEN ELDEN AND ORANGE AVENUES AND MONTE VISTA
AND DEL MAR AVENUES.
WHEREAS, the City Council of the City of Costa Mesa did, on the
7th day of June, 1976, pass and adopt Resolution No. 76-74 entitled: A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA,
DECLARING ITS INTENTION TO ORDER THE VACATION OF EXCESS RIGHT-OF-WAY IN
PORTIONS OF LOTS 79 AND 80 OF TRACT 300, LOCATED IN THE GENERAL AREA
BETWEEN ELDEN AND ORANGE AVENUES AND MONTE VISTA AND DEL MAR AVENUES:
and
WHEREAS, pursuant to said Resolution of Intention, the time and
place for hearing all persons interested in or objecting to the proposed
vacation was set for Tuesday, July 6, 1976, at the hour of 6:30 p.m., in
the Council Chambers of City Hall, 77 Fair Drive, Costa Mesa, Cali-
fornia; and
WHEREAS, notices of said proposed vacation were duly and regularly
posted as required by law, all pursuant to the provisions of Section
8300 et seq. of the Streets and Highways Code of the State of Cali-
fornia; and
WHEREAS, said date of hearing coming on regularly to be heard, all
persons appearing on the proposed vacation were heard, and said hearing
was closed on the 6th day of July, 1976; and
WHEREAS, the City Council of the City of Costa Mesa finds and
determines, from all the evidence submitted, that the hereinafter described
right-of-way is unnecessary for present or prospective street purposes;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES
ORDER AND RESOLVE AS FOLLOWS:
1. That the hereinafter described right-of-way is unnecessary for
present or prospective street purposes.
2. It is hereby ordered that the following described right-of-way,
be, and the same is hereby vacated:
Those portions of Lots 79 and 80 of Tract No. 300, as
shown on a map recorded in Book 14, Pages 11 and 12 of
Miscellaneous Maps, Records of Orange County, California,
described as follows:
The southeasterly 30.00 feet of the northwesterly 305.00
feet of said Lots 79 and 80;
EXCEPTING therefrom the southwesterly 60.00 feet of said
Lot 80.
For the purpose of this
description, it is
intended that
the northwesterly line
of said Lots 79 and
80 are 25.00
feet southeasterly and
parallel to the centerline of
Elden Avenue as shown on
said map of Tract
No. 300.
RESERVING therefrom an easement for all existing under-
ground and overhead public utilities, together with the
right of ingress and egress for the purpose of maintain-
ing, replacing, and upgrading said existing public
utilities.
PASSED AND ADOPTED this 6th day of July, 1976.
